Criteria for participating in official recruitment exams; 1 additional occupational disease covered by social insurance; requirements for credit institutions to provide electronic guarantee; etc., are notable new policies of Vietnam that will be covered in this bulletin.
1. New regulation of Vietnam on the criteria for participating in the official recruitment exam
The Government of Vietnam promulgated Decree No. 06/2023/ND-CP on the official recruitment exam, effective as of April 10, 2023.
According to the Decree, the criteria for participating in the official recruitment exam are as follows:
- The criteria for participating in the official recruitment exam shall comply with Clause 1 Article 36 of the Law on Officials and Public Employees:
+ Having one nationality, which is Vietnamese nationality;
+ Being at least 18 years old;
+ Having applied an application with a clear background;
+ Having suitable certificates or diplomas;
+ Having good political and moral qualities;
+ Having adequate health for task performance;
+ Other requirements according to the applied position.
- Officials that fall under the following cases shall be ineligible for participating in the official recruitment exam as prescribed in Clause 2 Article 36 of the Law on Officials and Public Employees:
+ Not residing in Vietnam;
+ Incapacitated or having limited legal capacity;
+ Being criminally prosecuted; serving a sentence or having unspent conviction; undergoing mandatory treatment in a medical service facility or attending a reformatory school as an administrative penalty.
2. Vietnam to add 1 more disease to the list of occupational diseases covered by social insurance as of April 1, 2023
This is the content of Circular No. 02/2023/TT-BYT dated February 9, 2023 on amendments to Circular No. 15/2016/TT-BYT on occupational diseases covered by social insurance promulgated by the Minister of Health of Vietnam, effective as of April 1, 2023.
Specifically, Clause 35 prescribing occupational COVID-19 has been added to Article 3 of Circular No. 15/2016/TT-BYT.
At the same time, Appendix 35 on guidelines for occupational COVID-19 diagnosis and assessment and Appendix 36 on occupational SARS-CoV-2 exposure record have been added to Circular No. 15/2016/TT-BYT.
3. Vietnam to add the professional title of cultural propagandist as of April 10, 2023
On February 21, 2023, the Minister of Cultural, Sports and Tourism of Vietnam promulgated Circular No. 02/2023/TT-BVHTTDL on codes and standards of the professional title and salary classification of cultural propagandists, effective as of April 10, 2023.
According to the Circular, regulations on codes of the professional titles of cultural propagandists are as follows:
- Principal cultural propagandist: V.10.10.34;
- Cultural propagandist: V.10.10.35;
- Intermediate-level cultural propagandist: V.10.10.36.
Additionally, regulations on the salary classification of cultural propagandists are as follows:
- The professional title of the principal cultural propagandist is eligible for the pay grade for public employees type A2, group 2 (A2.2), from the pay coefficient of 4,00 to 6,38;
- The professional title of the cultural propagandist is eligible for the pay grade for public employees type A1, from the pay coefficient of 2,34 to 4,98;
- The professional title of the intermediate-level cultural propagandist is eligible for the pay grade for public employees type B, from the pay coefficient of 1,86 to 4,06;
4. New regulation of Vietnam on requirements for credit institutions to provide electronic guarantee
The State Bank of Vietnam promulgated Circular No. 11/2022/TT-NHNN on bank guarantee, effective as of April 1, 2023.
According to the Circular, credit institutions, foreign bank branches, and customers may provide guarantee electronically (hereinafter referred to as “e-guarantee”).
Specifically, credits institutions and foreign bank branches shall decide on their own methods, forms, and technologies adopted to provide e-guarantee for the entire or each stage of the guarantee process, incur all risks (if any), and meet the following requirements:
- They have adopted solutions and technologies to ensure accuracy, confidentiality, and safety during the collection, use, and verification of information and data;
- They have adopted measures to examine, check, update, and verify information and data; measures to prevent acts of forging, intervening, and falsifying information and data;
- They have adopted measures to assess, manage, and control risks and assigned specific responsibilities to each relevant division and individual in providing e-guarantee and conducting risk management and supervision.
