Notable new policies of Vietnam effective from the end of October 2023

Exemption from license plate issuance fees for motor tricycles for the disabled from October 22, 2023; regulation on accounts on the specialized database on home affairs; etc., are notable new policies that will be covered in this bulletin.

1. Exemption from license plate issuance fees for motor tricycles for the disabled from October 22, 2023 in Vietnam

On September 7, 2023, the Minister of Finance of Vietnam promulgated Circular No. 60/2023/TT-BTC on fees for registration and license plate issuance of road motor vehicles, collection, payment, exemption, and management thereof.

According to the Circular, from October 22, 2023, motor tricycles for the disabled are eligible for the exemption from fees for registration and license plate issuance.

Previously, in Article 5 of Circular No. 229/2016/TT-BTC, fees for the grant of registration certificates together with license plates for motor tricycles for the disabled were as follows:

- Zone I: 50.000 VND;

- Zone II: 50.000 VND;

- Zone III: 50.000 VND;

Circular No. 60/2023/TT-BTC comes into force as of October 22, 2023.

2. New regulation of Vietnam on accounts on the specialized database on home affairs

On September 5, 2023, the Minister of Home Affairs of Vietnam promulgated Circular No. 14/2023/TT-BNV on the Regulation on update, utilization, and management of specialized databases on home affairs.

According to the Circular, accounts on the specialized database on home affairs are granted to organizations and individuals for administration, data update, utilization, and use of information from the specialized database on home affairs.

Specifically:

- The account administrating the specialized database on home affairs shall be managed by the Ministry of Home Affairs of Vietnam.

- Administration accounts of Ministries, ministerial agencies, governmental agencies, central agencies, provinces, and centrally affiliated cities (data management agencies grade II) shall be granted and assigned to them by the Ministry of Home Affairs of Vietnam for management and use.

- Administration accounts of agencies and units shall be granted and assigned to them by the superior data management agencies grade II for management and use. Accounts for utilization and use of units and individuals of and affiliated with agencies and units shall be granted by such agencies and units for management and use.

- Organizations and individuals with assigned accounts shall take responsibility for the confidentiality of the accounts and data and manage and use such accounts in compliance with the prescribed purposes and functions.

Circular No. 14/2023/TT-BNV comes into force as of October 26, 2023.

3. 4 types of state audit records from October 21, 2023 in Vietnam

On September 6, 2023, the Auditor General of the State Audit Office of Vietnam promulgated Decision No. 11/2023/QD-KTNN on the list of audit documents; regulations on archive, preservation, utilization, and destruction of audit documents.

According to the Decision, the types of audit records of an audit from October 21, 2023 will include:

 (1) General audit record of the Audit Delegation;

 (2) Detailed audit record of the Audit Team;

 (3) Record on the inspection of the implementation of audit conclusion or suggestion; record on the settlement of complaint, suggestion, and lawsuit in state audit operations;

 (4) Audit quality control record of the Head Auditor of the professional or regional State Audit Office and Directors of Counseling Departments assigned to take charge of the audit (referred to as “Head Auditors”).

Decision No. 11/2023/QD-KTNN comes into force as of October 21, 2023.

4. Principles of identifying job positions of professional officials specializing in office work

On September 11, 2023, the Minister, Head of the Office of the Government of Vietnam, promulgated Circular No. 02/2023/TT-VPCP on guidelines on job positions of professional officials specializing in office work in administrative agencies and organizations.

According to the Circular, job positions of professional officials specializing in office work in administrative agencies and organizations are identified based on the principles prescribed in Article 3 of Decree No. 62/2020/ND-CP, specifically:

- Complying with regulations of the CPV and laws on job positions and management and use of the payroll for officials.

- Ensuring conformity with the functions, tasks, entitlements, and organizational structure of agencies and organizations.

- Ensuring uniformity and synchronicity between the identification of job positions and the structure of pay grades for officials with the use and management of the payroll for officials.

- Ensuring scientificity, objectivity, publicity, transparency, democracy, and conformity with practice.  

- Associating the payroll downsizing with the re-structuring and improvement of the quality of officials in agencies and organizations.

Circular No. 02/2023/TT-VPCP comes into force as of October 25, 2023.
