Notable new policies of Vietnam effective from the end of February 2023

Promulgation of the system of forms of audit dossiers of the State Audit Office of Vietnam; amendments to regulations on the number of contestants participating in the national excellent student selection exam; etc., are notable new policies that will be effective from the end of February 2023 (from February 21 to February 28, 2023).

1. Types of contracts in administrative agencies and public service providers

On December 30, 2022, the Government of Vietnam promulgated Decree No. 111/2022/ND-CP on contracts for several types of work in administrative agencies and public service providers.

According to the Decree, types of contracts in administrative agencies and public service providers include:

- Service contracts according to civil laws and other relevant laws;

- Labor contracts according to laws on labor and this Decree.

The mentioned types of contracts shall be concluded in writing. In case a contract is concluded via electronic means in the form of a data message according to laws on e-transactions, it has the same validity as a written contract.  

Decree No. 111/2022/ND-CP comes into force as of February 22, 2023 and replaces Decree No. 68/2000/ND-CP, Article 3 of Decree No. 161/2018/ND-CP, Clause 2 Article 7 of Decree No. 06/2013/ND-CP, and Resolution No. 102/NQ-CP.

2. Amendments to regulations on the number of contestants participating in the national excellent student selection exam

This is the content of Circular No. 02/2023/TT-BGDDT dated January 6, 2023 on amendments to the regulation on the national excellent student selection exam enclosed with Circular No. 56/2011/TT-BGDDT amended by Circular No. 41/2012/TT-BGDDT and Circular No. 37/2013/TT-BGDDT, which comes into force as of February 21, 2023.

According to the Circular, the number of contestants participating in the national excellent student selection exam is as follows:

- Teams for each subject of each participating unit (except for the participating units of Hanoi) shall have a maximum of 6 contestants; teams with a sufficient number of contestants and at least 80% of such contestants achieved prizes in 2 consecutive national excellent student selection exams shall be considered for having a maximum of 10 contestants by the Ministry of Education and Training of Vietnam.

- Teams for each subject of participating units of Hanoi shall have a maximum of 12 contestants; teams with a sufficient number of contestants and at least 80% of such contestants achieved prizes in 2 consecutive national excellent student selection exams shall be considered for having a maximum of 20 contestants by the Ministry of Education and Training of Vietnam.

(Previously, only teams with contestants who have achieved prizes in 2 consecutive national excellent selection exams right before the exam year may be considered for the increase of the maximum contestant)

3. Promulgation of the system of forms of audit dossiers of the State Audit Office of Vietnam

On January 10, 2023, the Deputy Auditor General of the State Audit Office of Vietnam promulgated Decision No. 01/2023/QD-KTNN on the system of forms of audit dossiers.

According to the Decision, the system of forms of audit dossiers of the State Audit Office of Vietnam includes:

- State budget audit sector: 12 forms

(Decision No. 01/2023/QD-KTNN has removed form No. 06/BBKT-NSDP and form No. 07/BBKT-NSDP)

- Construction investment project audit sector: 4 forms

- Objective program audit sector: 3 forms

- Corporate audit sector: 6 forms

- Administrative organization audit sector and banking audit sector: 4 forms

- Audit sectors of national defense and security and CPV finance: 3 forms

- General dossiers: 30 forms

(Decision No. 01/2023/QD-KTNN has added form No. 30/CVTB)

Decision No. 01/2023/QD-KTNN comes into force as of February 24, 2023 and replaces Decision No. 01/2020/QD-KTNN dated June 26, 2020.

4. Education quality assurance operations of vocational education - continuing education centers

This is the content of Circular No. 01/2023/TT-BGDDT dated January 6, 2023 on regulations on the organization and operations of vocational education - continuing education centers, effective as of February 22, 2023.

Centers shall perform quality assurance operations and education quality according to regulations and shall:

- Consult with CPV committees and local authorities on the preparation of plans to construct, develop, and strive in each stage for them to meet the education quality accreditation.

- Organize self-assessment, register external assessment, and request competent authorities to recognize their education quality accreditation satisfactory when deeming that center assessment standards are satisfied as per regulation.

- Supplement and complete self-assessment reports based on the result of the external assessment; execute plans to improve the quality of self-assessment reports, recommendations of external assessment delegations, and directives of management agencies.

Submit annual reports on the result of the quality improvement to their direct education management agencies to receive guidance, directive, inspection, and supervision.

- Prepare sufficient documents, data related to their operations, and necessary conditions for external assessment and provide timely answers to recommendations on the drafts of external assessment reports.

- Maintain and promote the results of education quality accreditation to constantly improve the quality.
