Notable new policies of Vietnam effective as of the middle of September 2024

Funding support for artificial breeding for buffaloes, cows, and pigs from September 20, 2024; standards of inspection officials specializing in transport from September 20, 2024; grounds to determine structure of public employees engaging in archive work from September 15, 2024; etc., are notable policies that will be covered in this bulletin.

1. Funding support for artificial breeding for buffaloes, cows, and pigs in Vietnam from September 20, 2024 

On August 1, 2024, the Government of Vietnam promulgated Decree No. 106/2024/ND-CP on policies supporting the improvement of the effectiveness of animal husbandry, which stipulates policies encouraging livestock waste treatment. Specifically, organizations and individuals meeting specific conditions shall be entitled to support for artificial breeding for buffaloes, cows, and pigs as follows: 

- 100% support for the costs of supplies for artificial breeding for cattle, including frozen sperm, liquid nitrogen, gloves, and insemination devices for breeding for buffaloes and cows; up to 3 doses of sperm per instance of pregnancy for buffaloes and dairy cows and 2 doses of sperm per instance of pregnancy for beef cattle. 

- 100% support for the costs of sperm doses for breeding sows; up to 2 doses of sperm per instance of breeding and up to 6 doses per sow per year. 

- Financial support for individuals trained in techniques for artificial breeding for cattle (buffaloes and cows) according to actual costs by up to 2 months of the base salary per person per course. 

- One-time support of up to 30% of the cost of procuring liquid nitrogen containers for preserving sperm for persons providing cattle (buffaloes and cows) artificial breeding services; up to 5 million VND per container per person. 

- Support for the work of artificial breeding for cattle (buffaloes and cows), up to 300.000 VND per pregnant breeding animal.

2. Standards of inspection officials specializing in transport in Vietnam from September 20, 2024 

On August 1, 2024, the Minister of Transport of Vietnam Circular No. 29/2024/TT-BGTVT on conditions, standards, uniforms, and specialized inspector’s cards of persons assigned to perform tasks of inspections concerning transport; tasks and entitlements of agencies carrying out functions of inspections concerning transport. 

According to the Circular, conditions and standards of inspection officials specializing in transport are as follows: 

- Inspection officials specializing in transport are officials of advisory organizations assisting directors of agencies assigned to perform inspections of the Ministry of Transport of Vietnam or affiliates of agencies assigned to perform inspections of the Ministry of Transport of Vietnam.

- Inspection officials specializing in transport shall ensure the conditions and standards prescribed in Clause 3 Article 38 of the Law on Inspection 2022 and the following conditions and standards: 

+ Inspection officials specializing in transport of the Department for Roads of Vietnam, Vietnam Railway Authority, and Vietnam Inland Waterways Administration shall have at least bachelor’s degrees in conformity with the requirements for the job position regarding one of the majors relevant to transport, construction, architecture, mechanics, information technology, telecommunications, law, economy, and finance; 

+ Inspection officials specializing in transport of Vietnam Register shall have at least bachelor’s degrees in conformity with the requirements for the job position regarding one of the technical majors relevant to vehicle inspection, transport devices, or one of the majors concerning law and finance.

3. Grounds to determine structure of public employees engaging in archive work in Vietnam from September 15, 2024 

On July 26, 2024, the Minister of Home Affairs of Vietnam promulgated Circular No. 09/2024/TT-BNV on guidelines on the structure of public employees by professional titles and norms for the number of workers in public service providers concerning archive work. 

According to the Circular, the grounds to determine the structure of public employees by professional titles and the number of workers are as follows: 

- The structure of public employees by professional titles in historical archives of the State at the central and provincial levels shall be determined under Clause 5 Article 3 and Clause 3 Article 4 of Decree No. 106/2020/ND-CP regarding the job positions and the number of workers in public service providers. 

- The number of workers in historical archives of the State at the central and provincial levels shall be determined under Clause 2 Article 4 of Decree No. 106/2020/ND-CP and the following grounds: 

+ Volume of documents. 

+ Quantities and characteristics of material sources. 

+ Document types. 

+ Physical conditions of documents. 

+ Linguistic characteristics of documents. 

+ Requirements for document value promotion. 

+ Requirements for implementation of archive work. 

+ Actual status of specialized archives, information infrastructures, and information technology application levels. 

- The number of workers in historical archives of the State at the central and provincial levels does not include the number of workers working in support and service job positions.

4. Criteria for classification of public service providers concerning labor, meritorious persons, and society in Vietnam 

On July 31, 2024, the Minister of Labor - War Invalids and Social Affairs of Vietnam promulgated Circular No. 08/2024/TT-BLDTBXH on specific classification criteria, conditions for establishment, merger, consolidation, and dissolution of public service providers in fields of labor, meritorious persons, and society.

Specifically, the criteria for the classification of public service providers concerning labor, meritorious persons, and society are as follows:

(1) Classification based on functions and tasks

- Public service providers serving the state management; 

+ Public service providers implementing research serving the determination of strategies and development and completion of constitutions and policies on labor, meritorious persons, and society; 

+ Public service providers disseminating guidelines and policies of the CPV, laws of the State, and information concerning labor, meritorious persons, and society; 

+ Public service providers implementing other functions in service of the state management of labor, meritorious persons, and society.  

- Public service providers providing public services 

+ Public service providers providing public services using the state budget concerning labor, meritorious persons, and society according to lists approved by competent authorities;

+ Public service providers providing other public services concerning labor, meritorious persons, and society. 

- Public service providers that serve the state management and provide public services are units implementing one or many functions and tasks mentioned above. 

(2) Classification according to authorities competent to decide on the establishment

- Public service providers established under the jurisdiction of the Government of Vietnam and the Prime Minister of Vietnam. 

- Public service providers established under the jurisdiction of Ministers, Directors of ministerial agencies, Directors of governmental agencies, and heads of agencies established by the Government of Vietnam or the Prime Minister of Vietnam that are not public service providers. 

- Public service providers established under the jurisdiction of People’s Committees of provinces and centrally affiliated cities.

- Public service providers established under the jurisdiction of other agencies according to the law and decentralization by competent authorities. 

(3) Classification based on the level of financial autonomy 

- Public service providers that cover their recurrent expenditures and expenditures on investment; 

- Public service providers that cover their recurrent expenditures; 

- Public service providers that partially cover their recurrent expenditures; 

- Public service providers whose recurrent expenditures are covered by the State; 

The determination of the level of financial autonomy of public service providers concerning labor, meritorious persons, and society shall comply with the Decrees of the Government of Vietnam and documents relevant to regulations on financial autonomy mechanisms of public service providers.
