LawNet would like to introduce to customers the following outstanding new policies that will come into effect from mid-November 2021 (from 11 November to 20 November, 2021):

1. Remuneration for trainers for training in the new educational program in Vietnam

This is the content of Circular 83/2021/TT-BTC of Vietnam guiding the management of training and retraining funds for teachers and educational institution managers to implement new programs and new textbooks for general education, effective from November 20, 2021.

Specifically, based on the quality requirements of training and retraining courses, heads of agencies and units assigned to organize training courses decide on the level of remuneration for lecturers and teaching assistants (if any). local rapporteur (including face-to-face and online training); remuneration for staff to supervise and operate the online learning system on the basis of an agreement in accordance with the quality and qualifications of lecturers and reporters within the assigned estimate.

Maximum total payment: 2,000,000 VND/session (one lecture is equal to 4 lessons), calculated for all members who directly participate in guiding and teaching in 1 training nursing session. The number of members participating in guiding and teaching in a class is regulated by the Ministry of Education and Training of Vietnam.

The number of teaching hours exceeding the norm of professional lecturers is paid according to the overtime pay regime for teachers in public educational institutions according to Joint Circular 07/2013/TTLT-BGDĐT-BNV- BTC of Vietnam

In addition, lecturers are also entitled to meal allowances, transportation payments, room rentals, exam questions, examination, and exam marking.

2. Periodically change the inspection position every 3-5 years in Vietnam

Circular 03/2021/TT-TTCP of Vietnam detailing the list and periodical deadlines for changing working positions at the Government Inspectorate and working positions in the field of inspection, citizen reception, and complaint settlement, denunciation, prevention and fight against corruption in local government, effective from November 20, 2021.

According to the Circular, the period of periodic change of working positions is from 3 to 5 years for the following positions:

* About the list of changing positions at the Government Inspectorate include:

- Inspection position.

- The position of citizen reception.

- Position in handling complaints and denunciations.

- Position in anti-corruption work.

- The position of supervision, appraisal and handling after inspection.

- Other working positions are specified in Clause 2, Article 36 of Decree 59/2019/ND-CP of Vietnam

* Regarding the list of periodically changing working positions in the field of inspection, citizen reception, settlement of complaints and denunciations, and anti-corruption at local authorities, including:

- Inspection position.

- The position of citizen reception.

- Position in handling complaints and denunciations.

- Position in anti-corruption work.

- The position of supervision, appraisal and handling after inspection.

3. Principles of revenue recognition of local development investment funds in Vietnam 

This is the content of Circular 86/2021/TT-BTC of Vietnam guiding Decree 147/2020/ND-CP on organization and operation of Local Development Investment Fund, effective from November 20, 2021.

According to the Circular, the revenues of the Local Development Investment Fund must be determined in accordance with Vietnamese standards and relevant laws, have valid invoices or vouchers, and must be recorded. fully charged to revenue.

With regard to interest income from lending activities, the Local Development Investment Fund is responsible for assessing the debt recovery ability and classifying debts in accordance with the provisions of Decree 147/2020/ND-CP of Vietnam as a basis for accounting of interest receivable and accounting as follows:

- The Fund records interest receivable from lending activities arising in the period into loan interest revenue for debts classified as qualified debts that are not required to make specific provisions for risks as prescribed in Clause 1 of Article 30 of Decree 147/2020/ND-CP.

- For the amount of interest receivable of debts that are kept intact in the group of qualified debts due to the implementation of the State's policies and the amount of interest receivable arising in the period of the remaining debts, income is not required to be accounted for.

4. Cases not allowed to join the inspection team in Vietnam 

The Government Inspectorate has issued Circular 06/2021/TT-TTCP of Vietnam stipulating the organization and operation of the inspection team and the order and procedures for conducting an inspection.

According to the Circular, people in one of the following cases are not allowed to join the inspection team:

- Persons having shares in enterprises are subject to inspection unless otherwise provided for by law;

- The person whose spouse, father, mother, child, brother, sister is the head, the deputy of the head, the person in charge of the organization of personnel, accounting, treasurer, and warehouses in agencies, organizations or units that are subject to inspection;

- Persons being considered for disciplinary action or being examined for penal liability;

- Persons who commit violations shall be handled according to the provisions of Clauses 1 and 2, Article 51 of Circular 06/2021/TT-TTCP of Vietnam but the time limit for disciplinary and criminal record remission has not yet expired;

- Persons who do not meet other conditions to join the inspection team as prescribed by law.

In addition, the person who falls into one of the above cases or who has a spouse, father, mother, father, mother-in-law or father, mother-in-law, child, brother, sister, biological brother, or sister. of a spouse working at an agency, organization or unit that is subject to inspection may not be the head of the inspection team.

Circular 06/2021/TT-TTCP of Vietnam takes effect from November 15, 2021.
