1. Border guards are given priority to allocate residential land when there is a need

This is a prominent content in   Decree 106/2021/ND-CP  detailing a number of articles of the Vietnam Border Law, effective from January 21, 2022.

Specifically, officers, professional soldiers, workers and defense officers of the Border Guard, performing the task of protecting borders and islands, are given priority by the local government where they move to, according to regulations. of land law; support in accommodation, housing for their families, jobs for their spouses and enjoy other regimes and policies as prescribed when:

- Having worked for 5 years or more;

- Having a need to move their family to settle down and settle down for a long-term life in border and island areas.

(Currently, Decree 02/1998/ND-CP does not provide for this policy).

2. More border gates are allowed to import passenger cars with under 16 seats

The Ministry of Industry and Trade has issued  Circular 21/2021/TT-BCT  regulating the import border gate for passenger cars with under 16 seats, effective from January 24, 2022.

Accordingly, it is regulated that passenger cars with under 16 seats can only be imported to Vietnam through the following seaport border gates:

- Quang Ninh (Cai Lan);

- Hai Phong;

- Thanh Hoa (Nghi Son);

- Danang;

- Ho Chi Minh City;

- BA Ria Vung Tau.

(Compared to the current one, from January 24, 2022, Thanh Hoa seaport border gate (Nghi Son) will be added to the list of seaport border gates allowed to import passenger cars with under 16 seats).

Import procedures shall comply with relevant legal provisions.

3. More non-refundable expenses when protecting citizens abroad

The Ministry of Finance promulgates  Circular 110/2021/TT-BTC  stipulating the estimation, management, use and finalization of funds for performing the task of protecting overseas Vietnamese citizens and legal entities. force from January 26, 2022.

In which, the contents of non-refundable expenditure for activities directly performing the task of protecting Vietnamese citizens and legal entities abroad of overseas Vietnamese representative missions include:

- Expenses for staff of overseas Vietnamese representative missions to go on business trips to serve the task of protecting Vietnamese citizens and legal entities abroad;

To visit the consulate to find out the situation in cases where citizens are arrested, detained, detained, tried or imprisoned in the following cases:

Airfares, trains, fuel, and per diem according to the regime specified in Circular 07/2020/TT-BTC dated February 3, 2020.

- Fees for communication, postage for sending documents to protect citizens;

Spending on inviting meals and giving gifts to agencies and organizations of the host country's government in order to facilitate the settlement of cases of protection of Vietnamese citizens and legal entities abroad according to the provisions of Circular 07/2020/TT- BTC on 03/02/2020. (New content added)

- Expenses for supporting cases of citizens who are extremely difficult, suffering from serious diseases, supporting expenses for returning citizens who are victims of human trafficking crimes...

4. Employees working in these regions can retire early

This is the content of Circular 19/2021/TT-BLDTBXH  on the list of regions with extremely difficult socio-economic conditions to determine the case where it is possible to retire at an age lower than the retirement age in working conditions. normal operation, effective from January 30, 2022.

Accordingly, there are 27 provinces, cities, 01 other production and administrative unit with extremely difficult socio-economic conditions as a basis for determining the cases where it is possible to retire at a lower age as prescribed. in Clause 3, Article 169  of the Labor Code  and Article 5  of Decree 135/2020/ND-CP , for example:

- Bac Kan province: 05 districts, 20 communes;

- Binh Phuoc province: 02 districts, 04 communes;

- Binh Thuan province: 01 district, 01 commune;

- Cao Bang province: 07 districts, 58 communes and 01 town;

- Dak Lak Province: 06 districts, 14 communes;

- Khanh Hoa province: the whole Truong Sa district;

- Kien Giang province: Phu Quoc district, Tho Chau commune;

- Lam Dong province: 05 districts, 25 communes;

- Other production and administrative units: DK1 rig house;...

The time employees work before January 1, 2021 is based on the area where the regional allowance coefficient of 0.7 or more is available as a basis for determining the cases in which they can retire at an age lower than the retirement age. retired under normal working conditions.
