Year 2020: Outstanding Students Recruited Officially without Examination

This is a new regulation in the Law amending and supplementing a number of articles of the Law on Cadre, Official and the Law on Public Employees just passed by the National Assembly on November 25, 2019.

Clause 5, Article 1 of the 2019 Amended Law on Cadres, Officials, and Public Employees stipulates that the recruitment of officials shall be conducted through examinations or selection, except as provided in Clause 3 of this Article. The forms and contents of examinations and selection must comply with the job position's requirements in each sector and profession, ensuring the selection of individuals with the appropriate qualities, levels, and capabilities.

The recruitment of officials through selection is decided by the competent authority for recruitment for the following groups:

- Committed to voluntarily work for 05 years or more in areas with particularly difficult socio-economic conditions;- Persons studying under the policy of assignment as prescribed by the Education Law, after graduation, return to work at the locality sending them to study;- Outstanding graduates, talented young scientists.

It can be seen that, compared to the provisions of the 2008 Law on Cadres and Officials, the new Law has added 02 cases of recruitment of officials without examination, namely persons studying under the assignment policy and outstanding graduates, talented young scientists. This new provision opens up more opportunities for students and talented individuals to work locally, reflecting the state's deep concern for young human resources.

The Law also stipulates that, in addition to recruitment through examinations and selections, the head of the authority managing officials may decide to accept persons meeting the standards and conditions of the job position into official ranks in the following cases:

- Public employees working at public service providers;- Cadres, officials at commune level;- Persons receiving salaries in the people's armed forces, persons working in cipher organizations but not officials;- Hiring to appoint officials to leadership and management positions for those who are currently Chairman of the Members' Council, Chairman of the Board of Directors, Company President, Member of the Members' Council, Member of the Board of Directors, Controller, General Director, Deputy General Director, Director, Deputy Director, Chief Accountant, and those holding other managerial positions complying with the regulations of the Government of Vietnam in state-owned enterprises and enterprises with more than 50% state-controlled capital; accepted individuals must be planned for the appointment position or an equivalent position;- Persons who were officials but were then transferred or rotated by competent authorities to hold non-official positions in other agencies and organizations.

However, these cases are considered for acceptance into official ranks if they are not in the period of disciplinary action, not in the implementation period of regulations related to discipline as stipulated in Article 82 of the 2008 Law on Cadres and Officials; cases specified in points a, b, c, and d of Clause 3 of this Article must have at least 05 years of work experience appropriate to the field of acceptance.
