According to the provisions of Article 3 of Resolution 86/2019/QH14, the National Assembly of Vietnam assigns the Government of Vietnam to adjust the increase in the statutory pay rate from 1.49 million VND/month to 1.6 million VND/month and simultaneously adjust pensions, social insurance benefits, and monthly allowances accordingly (for entities funded by the state budget), and preferential allowances for people with revolutionary contributions to equal the statutory pay rate from July 1, 2020.
However, due to the impact of the COVID-19 pandemic, the Politburo and the National Assembly of Vietnam have agreed on failure to increase the statutory pay rate for Vietnamese officials and public employees and armed forces from July 1, 2020, until further notice as stated in Conclusion 77-KL/TW on June 5, 2020, and Resolution 122/2020/QH14 on June 19, 2020.
Recently, in Resolution 128/2020/QH14 on the state budget estimate for 2021 passed at the 10th meeting of the 14th National Assembly, the National Assembly of Vietnam also agreed that in 2021, the statutory pay rate and the poverty threshold would not be adjusted.
Also related to the statutory pay rate, through the Resolution, in 2020, there will also be no adjustment of the statutory pay rate, pensions, social insurance benefits, or monthly allowances (for entities funded by the state budget), and preferential allowances for people with revolutionary contributions. Efforts will be concentrated on combating the COVID-19 pandemic, overcoming the consequences of natural disasters, implementing issued social security policies, and ensuring national defense, security, and foreign affairs.
Thus, due to the impact of the Covid-19 pandemic, the National Assembly of Vietnam agreed to maintain the statutory pay rate 2021 unchanged at 1,490,000 VND/month as stipulated by Decree 38/2019/ND-CP regarding the statutory pay rate for officials and public employees and armed forces. Therefore, when the statutory pay rate 2021 is not increased to 1,600,000 VND/month, the Draft Decree stipulating the statutory pay rate for officials and public employees and armed forces in 2020 will not be promulgated.
Therefore, the following groups of officials and public employees will have no increase in income such as salaries and allowances based on the statutory pay rate 2021:
1. Officials from the central to district level (according to the provisions of Clauses 1 and 2, Article 4 of the Law on Officials 2008, as amended by Clause 1, Article 1 of the Law on Amendments to Law on Officials and Law on Public Employees 2019):
- Staffed officials receiving salaries funded by the State Budget are Vietnamese citizens, elected, ratified, or appointed to hold positions according to tenure in agencies of the Communist Party of Vietnam, the State, political-social organizations at the central, provincial, and municipal levels, districts, urban districts, towns, provincial cities.
- Staffed officials receiving salaries funded by the State Budget are Vietnamese citizens, recruited and appointed to positions corresponding to job positions in agencies of the Communist Party of Vietnam, the State, political-social organizations at the central, provincial, and district levels; in agencies and units belonging to the People's Army not being officers, professional army personnel, national defense workers; in agencies and units belonging to the People's Public Security not being officers, non-commissioned officers serving under professional policies, police workers.
2. Commune-level officials (according to Clause 3, Article 4 of the Law on Officials 2008):
- Commune-level officials are Vietnamese citizens, elected to hold positions according to tenure in the Standing Committee of the Commune People's Council, People's Committee, Secretary, Deputy Secretary of the Communist Party Committee, the head of political-social organizations;
- Staffed commune-level officials receiving salaries funded by the State Budget are Vietnamese citizens recruited to hold a specialized or professional title under the People's Committee at the commune level;
3. Public employees in public service providers.
4. Persons working under employment contracts and receiving salaries graded according to Decree 204/2004/ND-CP.
5. Staffed employees in associations supported by the State Budget under Decree 45/2010/ND-CP.
6. Officers, professional servicemen, non-commissioned officers, soldiers, and defense workers and employees of the Vietnam People's Army.
7. Officers, salaried non-commissioned officers, non-commissioned officers, conscripts, police workers, and contractual employees of the People's Public Security.
8. Persons working in cipher organizations.
9. Part-time employees of the communes, hamlets, and residential groups.
