When will officials and public employees in Vietnam have new payroll?

When will officials and public employees in Vietnam have new payroll? This is a question that LawNet receives quite a lot from customers and members in recent days. Regarding this issue, LawNet would like to answer as follows:

According to the Resolution No. 27/NQ-TW on salary policy reform for officials, public employees, armed forces and employees in enterprises, it is expected that in 2021, there will be a reform of the salary policy for officials, whereby 05 new payrolls applied for officials and public employees from 2021.

However, due to the impact of the Covid-19 epidemic, at the 13th Plenum of the Central Committee, the Central Executive Committee agreed with the proposal of the Vietnam Government's Party Personnel Committee on the time to officially implement the new salary system for officials and public employees, which is from July 1, 2022 instead of 2021, as the spirit of Resolution No. 27/NQ-TW of Vietnam Government.

Thus, it can basically be determined that until July 1, 2022, officials and public employees will have new payrolls, specifically new payrolls for officials and public employees according to the Resolution No. 27/NQ-TW of Vietnam Government, including:

- 01 position payroll applicable to officials and public employees holding leadership positions. In which:

+ The position salary must show the hierarchy in the political system; If a person holds a leadership position, he/she shall receive a salary according to that position; if a person holds multiple positions, he/she shall enjoy the highest position salary; holding similar leadership positions shall receive the same position salary.

+ The position salary of the superior leader must be higher than the position salary of the lower-level leader.

+ Regulating a position salary for each type of equivalent position; do not classify ministries, branches, boards, committees and equivalents at the central level when formulating the payroll for positions at the central level; regardless of salary and position difference for the same leadership title according to the classification of administrative units in the locality, but paid by allowances.

- 01 professional payroll according to officials ranks and professional titles of public employees, applicable to officials and public employees who do not hold leadership titles. In which, each rank of official, professional title of public employee has many salary levels according to the principle:

+ The same level of job complexity, the same salary.

+ Working conditions are higher than normal and job incentives are equal to the allowances according to the profession.

+ Rearrange the group of ranks and the number of ranks in the ranks of officials, professional titles of public employees, and encourage officials and public employees to improve their professional qualifications.

+ The appointment to the official rank or the public employee professional title must be associated with the job position and the structure of the official rank, and the public employee's professional title issued by the agency, organization or unit managing the official or public employee.

- 03 payrolls for the armed forces, including:

+ 01 payroll of military officers, officers and non-commissioned officers of the police force (according to positions, titles or ranks).

+ 01 payroll of professional military personnel, professional and technical police officers.

+ 01 payroll of defense workers and public security workers (including the current salary correlation of the armed forces with administrative officials).

It can be seen that, compared with the current payroll system in Decree No. 204/2004/ND-CP of the Government of Vietnam, the new payroll system from July 1, 2022 will no longer have a payroll for senior experts; payroll of specialized officials in communes, wards and townships and payrolls of employees serving in state agencies and state non-business units.
