Commune/Ward/Town is the lowest administrative unit within the three administrative levels of Vietnam, commonly referred to as the commune-level administrative unit. So, What is the number of commune-level officials at the commune-level administrative unit as stipulated by the law in Vietnam?

Clause 1, Article 2 of Decree 34/2019/ND-CP specifies the number of commune-level officials in Vietnam allocated according to the classification decision of administrative units at the commune, ward, and commune-level town levels. Tp be specific:
- Type 1: a maximum of 23 people;
- Type 2: a maximum of 21 people;
- Type 3: a maximum of 19 people.
The People's Committee of the province or centrally run city decides on the allocation of commune-level officials not to exceed the above number, ensuring the correct titles and matching the local practical situation. Specifically:
- Commune-level officials have the following positions:
- Secretary, Deputy Secretary of the Communist Party Committee;
- Chairman, Deputy Chairman of the People's Council;
- Chairman, Deputy Chairman of the People's Committee;
- Chairman of the Vietnam Fatherland Front Committee;
- Secretary of the Ho Chi Minh Communist Youth Union;
- Chairman of the Vietnam Women's Union;
- Chairman of the Vietnam Farmers' Union (applicable to communes, wards, and commune-level towns with agricultural, forestry, fishery, or salt production activities and with the Vietnam Farmers' Union organization);
- Chairman of the Vietnam Veterans' Association.
- Commune-level public employees have the following titles:
- Chief of Police;
- Military Commander;
- Office – Statistics;
- Land Administration – Construction – Urban Areas and Environment (for wards, commune-level towns) or Land Administration – Agriculture – Construction and Environment (for communes);
- Finance – Accounting
;- Justice – Civil Status;
- Culture – Social.
Note: For communes and commune-level towns with regular police chiefs, the number of officials will be reduced by 1 person.
The above number of commune-level officials includes both officials transferred, mobilized, or seconded to the commune level. In the case of transfers to hold the position of Deputy Chairman of the commune-level People's Committee, it is implemented according to Decree 08/2016/ND-CP on the number of Deputy Chairmen of the People's Committee and the process, procedures for election, resignation, dismissal, removal, mobilization, and dismissal of members of the People's Committee in Vietnam
Previously, the number of commune-level officials in Vietnam was specified in Decree 92/2009/ND-CP:
- Type 1 commune level: no more than 25 people;
- Type 2 commune level: no more than 23 people;
- Type 3 commune level: no more than 21 people;
Decree 34/2019/ND-CP amends Decree 92/2009/ND-CP, reducing the number of commune-level officials. For surplus officials due to staff reduction, the Chairman of the district-level People's Committee compiles and proposes to the Chairman of the provincial-level People's Committee to implement:

Streamlining the workforce according to Decree 108/2014/ND-CP on the policy of streamlining the workforce; Decree 113/2018/ND-CP amending and supplementing a number of articles of Decree 108/2014/ND-CP.

Settling policies for resignation according to the provisions of the Law on Cadres and Officials; early retirement; waiting for retirement, as regulated in Decree 26/2015/ND-CP on policies for officials not meeting age conditions for re-election or re-appointment to positions or titles according to the term in the Communist Party of Vietnam, State, and socio-political organizations.

Transferring and supplementing to other communes, wards, or commune-level towns within the district or to districts within the province; or transitioning to officials from the district level upwards according to Decree 161/2018/ND-CP amending and supplementing certain regulations on the recruitment of officials and public employees, promotion of officials, promotion of public employees, and implementation of contract policies for certain types of work in state administrative agencies and public service providers.
In cases where surplus officials are settled for resignation policies, based on relevant legal regulations and the local budget capacity, the provincial-level People's Committee submits to the same-level People's Council for consideration and decision on supporting redundancy for surplus non-specialized commune-level officials in Vietnam.
