Criteria and conditions for appointment of managerial officers in Vietnam

To be appointed as a management officer, the public employee needs to meet the criteria and conditions specified in Article 44 of Decree 115/2020/ND-CP, specifically as follows:

- Ensure general standards according to regulations of the Party and State and specific standards of appointed positions according to regulations of competent agencies and units.

- Must be assigned a position if it is a local source of human resources or an equivalent position if it is a source of human resources from another place. In the event that the newly established unit has not yet approved the planning, it shall be considered and decided by a competent authority.

- Have a verified personal profile and a declaration of assets and income as prescribed.

- Conditions of appointment age:

+ For public employees to be appointed for the first time to hold a managerial position or to be appointed to hold a higher management position, the appointment age must be full 05 years from the date of implementation of the appointment process; special cases report to competent authorities for consideration and decision;

+ For public employees who are proposed for appointment to hold a managerial position and hold the position for less than 5 years as prescribed by specialized laws, the working age must be full one term;

+ Being appointed public employees holding a new position equivalent to or lower than the current one, the appointment age shall not be calculated according to the above provisions.

- Have enough health to complete assigned tasks and responsibilities.

- Not fall into the cases of being banned from holding certain positions according to the Party's regulations and laws; not within the time limit for disciplinary action, not within the period of implementation of regulations related to public employee discipline specified in Article 56 of the Law on Public Employees as amended and supplemented in Clause 8 Article 2 of Law amending a number of articles of the Law on Cadres and Civil servants and the Law on Public Employees.

Components of the application for appointment of a management officer in Vietnam

Pursuant to Article 48 of Decree 115/2020/ND-CP, the appointment personnel file must be declared truthfully, accurately, and fully with the contents stated in the items and must be certified or authenticated by a competent authority as prescribed, including:

- A report on appointment signed by the head of the public non-business unit (in case of submitting to a competent superior for appointment decision) or signed by the head of the department in charge of personnel organization (for the case of the head of a public non-business unit);

- A summary of the vote counting results together with the vote counting minutes at each step in the appointment process;

- Curriculum vitae of public employees, declared by the individual according to the prescribed form, certified by the public non-business unit directly under the management, with a 4x6 color photo sticker, taken within a period of no more than 06 months;

- Self-review of the last 3 years of work;

- Comments and evaluations of the unit's leaders on ethical qualities, lifestyle, sense of organization and discipline, internal solidarity,
on working capacity, results of the performance of responsibilities and tasks in the last 3 years;

- Comments of the branch committee of the place of residence for himself and his family. If his/her place of residence is different from that of his/her family, he/she must obtain comments from the branch committee where he/she resides and where his/her family resides;

- Conclusion of the competent committee on political standards;

- A declaration of assets and income according to the prescribed form;

- Copies of diplomas and certificates as required by the standards of the appointed titles;

In case a diploma is granted by a foreign training institution or a domestic training institution affiliated with a foreign country, it must be certified by the Ministry of Education and Training;

- Health certificate issued by a competent medical facility within 6 months.
