On May 14, 2019, the Ministry of Education and Training of Vietnam issued Circular 09/2019/TT-BGDDT, stipulating the probationary period for teachers and lecturers according to the regulations in Decree 161/2018/ND-CP. So, what is the probationary period for teachers and lecturers under this regulation?

Previously, according to Circular 31/2018/TT-BGDDT, the probation period for the professional titles of teachers and lecturers was regulated as follows:
In order to be appointed to the professional title of teacher/lecturer, the recruited individual must undergo the following probation periods:
- For recruitment to the professional title of Grade III lecturer, Grade III high school teacher, or Grade III preparatory university teacher, the probation period is 12 months;
- For recruitment to the professional title of Grade III secondary school teacher, the probation period is 9 months;
- For recruitment to the professional title of Grade IV preschool teacher or Grade IV primary school teacher, the probation period is 6 months.
However, on May 14, 2019, by issuing Circular 09/2019/TT-BGDDT, the Ministry of Education and Training officially abolished Circular 31/2018/TT-BGDDT, which regulated the probation period for the professional titles of teachers and lecturers in public educational institutions.
From June 29, 2019, onward, the probation period for the professional titles of teachers and lecturers in public educational institutions will be implemented according to Clause 11, Article 2 of Decree 161/2018/ND-CP. Specifically, the probation policies for public employees are regulated as follows:
- 12 months for positions requiring a university degree. For the professional title of doctor, it is 09 months;
- 09 months for positions requiring a college degree;
- 06 months for positions requiring an intermediate level (vocational) degree.
Note:
- The maternity leave under social insurance benefits, sick leave of 14 days or more, unpaid leave, temporary detention, temporary custody, or temporary suspension from work as per the law, will not be counted in the probation period.
- Probation policies are not applicable for those who have previously worked with mandatory social insurance contributions according to legal regulations, are arranged to work in the same field, profession, or expertise that they were previously responsible for, and the period with mandatory social insurance contributions (if intermittent, they can be accumulated) is equal to or greater than the above-mentioned probation period.
It can be seen that from June 29, 2019, the probation period for teachers and lecturers is based on the requirement of educational qualification levels such as university, college, or intermediate, instead of each professional title position as regulated in Circular 31/2018/TT-BGDDT. Teachers and lecturers should take note of this regulation.
