The Ministry of Home Affairs of Vietnam is soliciting opinions on the Draft Decree on policies for officials, public employees and individuals receiving salaries in the armed forces working in economically and socially disadvantaged areas.
This Decree will replace Decree No. 116/2010/ND-CP, Decree No. 64/2009/ND-CP and annul a number of articles of Decree No. 61/2006/ND-CP of Vietnam’s Government.
Here are some noteworthy points mentioned in the Draft Decree:
Firstly, annulling the requirement for the period of service to be eligible for the allowance for the first time to work in economically and socially disadvantaged areas.
Specifically, Article 6 of the Draft states:
“Article 6. Allowance for the first time to work in economically and socially disadvantaged areas
The individuals specified in Article 2 of this Decree, who are recruited, transferred, assigned, or rotated to work for the first time in agencies, organizations, or units in economically and socially disadvantaged areas, are entitled to the following allowance:
The allowance for the first time to work in economically and socially disadvantaged areas is equivalent to 10 months of the base salary at the time of starting work in economically and socially disadvantaged areas; etc."
Thus, the requirements of 3 years for females and 5 years for males of service have been removed. The agencies, organizations, or units in economically and socially disadvantaged areas are responsible for promptly disbursing the allowances to the eligible individuals upon their arrival for duty, and this payment will be made only once during the total actual working time in economically and socially disadvantaged areas.
Secondly, supplementing profession-based preferential allowance for individuals working in economically and socially disadvantaged areas.
This is a new allowance that will apply to officials, public employees and individuals receiving salaries in the armed forces working in economically and socially disadvantaged areas.
Specifically, Article 11 of the draft specifies the profession-based preferential allowance as follows:
“The profession-based preferential allowance is equivalent to 70% of the current salary according to the position, title within the officials’ profession or professional title of public employees, based on the military rank or rank level, in addition to the leadership position allowance, seniority allowance beyond the salary scale (if applicable), and applies to the actual working time in economically and socially disadvantaged areas of the individuals specified in Article 2 of this Decree, including:
- Officials, public employees and workers who are educators, education management officials in educational institutions, vocational education institutions;
- Officials, public employees and workers directly involved in medical professional work in state medical establishments, including: Commune health stations; office and school health stations; regional general clinics; maternity houses; health centers; hospitals and other medical establishments from commune level upwards;
- Officers, professional soldiers, national defense officials, and military medical personnel directly involved in medical professional work at combined military-civilian health stations.”
Thirdly, stipulating allowances for mobility and allowances for teaching ethnic minority languages for educators and education management officials working in economically and socially disadvantaged areas.
Article 12 of the draft stipulates:
The mobility allowance is equivalent to 0.2 times the base salary for educators and education management officials who are responsible for eradicating illiteracy and promoting education and are required to regularly travel to villages and hamlets etc.
The allowance for teaching ethnic minority languages is equivalent to 50% of the regular salary, including the leadership allowance and professional allowance, for educators and education management officials teaching ethnic minority languages.
