Vietnam: Latest conditions for accepting commune-level cadres into officials in 2021

I am currently a commune-level cadre, do I need to pass the entrance exam to become an official in 2021? What are the conditions for a commune-level cadre to be accepted as an official according to Vietnam’s regulations?

1. Conditions for accepting commune-level cadres into officials

Pursuant to Article 18 of the Decree No. 138/2020/NĐ-CP of Vietnam’s Government, according to the requirements of the job position, a commune-level cadre may be admitted to an official through no examination if the following conditions are fully satisfied:

Firstly, commune-level cadres, regardless of ethnicity, male or female, social class, creed or religion, must meet the following conditions to apply for official recruitment:

- Having one nationality is Vietnamese nationality;

- Being at least 18 years of age;

- Having an application form; having a clear background;

- Having appropriate diplomas and certificates;

- Having good political and moral qualities;

- Having enough health to perform tasks;

- Other conditions as required by the position applied for.

Secondly, the commune-level cadre is not within the time limit for disciplinary action, nor during the period of implementing regulations related to discipline.

Thirdly, the commune-level cadre must have at least full 05 years of work (excluding probationary period, if there is a non-consecutive working time, it will be accumulated, including the working time if there was previously in a job position of other positions such as public employees, officials, salary earners in the people's armed forces, people working in cipher organizations) doing the job that requires professional training level suitable to the job position to be recruited.

2. Conditions for admission to commune-level cadres for commune-level cadres who have stopped holding positions

According to Clause 12 Article 1 of Decree No. 34/2019/NĐ-CP of Vietnam’s Government and Circular No. 13/2019/TT-BNV of the Ministry of Home Affairs of Vietnam, when resigning from the position of a commune-level cadre, such person may be considered and admitted to the commune-level cadres without passing the entrance exam if he/she fully meets the following criteria:

Firstly, he/she used to hold the following positions:

- Secretary, Deputy Secretary of the Party Committee;

- Chairman, Vice Chairman of the People's Council;

- Chairman, Vice Chairman of the People's Committee;

- Chairman of Vietnam Fatherland Front Committee;

- Secretary of the Ho Chi Minh Communist Youth Union;

- President of Vietnam Women's Union;

- Chairman of the Vietnam Farmers' Association (applicable to communes, wards and townships engaged in agricultural, forestry, fishery and salt production activities and organized by the Vietnam Farmers' Association);

- President of Vietnam Veterans Association.

Secondly, he/she meets the following standards:

- General standards:

+ Understanding of political theory, grasping the viewpoints, guidelines and lines of the Party, policies and laws of the State;

+ Capable of organizing and mobilizing local people to effectively implement the guidelines of the Party, policies and laws of the State;

+ Having the cultural and professional qualifications suitable to the requirements of the tasks and positions, having the capacity and health to complete the assigned tasks;

+ Understanding and respecting the customs and practices of the community in the working area.

- Specific standards:

+ Age: At least 18 years old;

+ General education level: Graduated from high school;

+ Professional qualifications: Graduated from a university or higher in a training discipline suitable to the requirements and duties of each commune-level cadre title; Provincial-level People's Committees shall specify standards for intermediate or higher professional qualifications for cadres working in communes: mountainous, highland, border, island, island communes, deep-lying, remote areas, ethnic minority areas, areas with extremely difficult socio-economic conditions;

+ Computer skill: Granted certificates of information technology use according to the basic information technology skills standards specified in Circular No. 03/2014/TT-BTTTT dated March 11, 2014 of the Ministry of Information and Communication of Vietnam.

Thirdly, the agency must still have the number and positions of commune-level cadres to be recruited.

Fourthly, you need to immediately meet the requirements of the position of commune-level civil servant to be recruited.

Fifthly, if you have never been a commune-level cadre before, one more condition must be added: the period of holding the position of commune-level cadre is at least 5 years (full 60 months) or more.

Finally, at the time of receipt not during the period of disciplinary review; be investigated, prosecuted, tried and not within the time limit subject to disciplinary action or criminal prosecution.
