Vietnam: Eligible age of civil servants to stand for election to National Assembly term XV

On January 20, 2021, the Central Organizing Committee of Vietnam issued Guide 36-HD/BTCTW on personnel work of deputies to the 15th National Assembly and People's Councils at all levels for the term 2021-2026.

Vietnam's Instruction 36-HD/BTCTW stipulates the age of full-time candidates for the 15th National Assembly as follows:

- Cadres, civil servants, and public employees who stand for election for the first time in general must be old enough to participate in 2 or more National Assembly courses, or at least one full course, specifically:

+ A male born in February 1966;

+ Female students from January 1971 onwards.

A member of the National Assembly in charge of re-election (except for co-members of the Standing Committee of the National Assembly) must be of at least half working age for a term (30 months) or more by May 2021. Specifically,

+ Male: from February 1966;

+ Female: from January 1971 onwards.

Particularly for National Assembly candidates who are army and public security officers, the age limit specified in the Law on Officers of the Vietnam People's Army and the Law on People's Public Security shall be followed.

- The cases of higher candidate age, such as members of the Party Central Committee and leaders of associations according to Vietnam's Conclusion 58-KL/TW dated September 12, 2019 of the Secretariat, shall be considered and decided by the competent authority to manage cadres.

- National Assembly deputies who are female cadres who retire at an older age according to the Politburo's conclusion and the Government's decree shall be counted as male, specifically:

  • The candidate for the first time was born in January 1966.

  •  

    People who were re-elected were born in July 1963 or later.

- Comrades who are not old enough to be re-elected but have not yet reached retirement age, the agency competent to manage cadres shall consider and arrange suitable jobs or maintain a number of regimes while waiting for full retirement age; comrades who wish to retire before age shall be settled in accordance with Vietnam's Decree 26/2015/ND-CP dated March 9, 2015 of the Government of Vietnam and Instruction 27-HD/BTCTW dated December 20, 2019 of the Central Organizing Committee.

- Full-time National Assembly deputies in the Central Government may hold working positions until the end of the 15th National Assembly term.

- Local full-time National Assembly deputies, upon reaching retirement age, shall stop holding positions and continue to perform the duties of National Assembly deputies until the end of their term.
