Regarding this issue, LawNet would like to answer as follows:

1. Criteria for grading the quality of cadres for not completing tasks

According to Article 7 of Decree 90/2020/ND-CP, officials who meet one of the following criteria are classified as failing to complete their tasks:

- There are signs of deterioration in political ideology, morality, lifestyle, self-evolution, and self-transformation according to the assessment of competent authorities.

- Having more than 50% of the criteria on the results of task performance as prescribed by law, according to the set plan, or according to the assigned specific tasks, but not yet ensuring progress, quality, and efficiency.

- The agency, organization, unit or branch or field of work assigned to complete less than 50% of the targets and tasks.

- Agencies, organizations and units directly under their respective management and responsibility for embezzlement, corruption and wastefulness and shall be handled in accordance with law.

- Violations in the course of task performance will be disciplined in the evaluation year.

2. Criteria for grading the quality of civil servants for not completing tasks in Vietnam

Specifically, in Article 11 of Decree 90/2020/ND-CP, the criteria for classifying the quality of civil servants at the level of not completing tasks are as follows:

* For civil servants who do not hold leadership or management positions in Vietnam

Civil servants who do not hold leadership or management positions with one of the following criteria shall be classified as failing to fulfill their tasks:

- There are signs of deterioration in political ideology, morality, lifestyle, self-evolution, and self-transformation according to the assessment of competent authorities;

- Failing to meet more than half of the criteria for the outcomes of task performance as prescribed by law, according to the set plan, or according to the assigned specific tasks;

- Violations in the course of task performance will be disciplined in the evaluation year.

* For civil servants holding leadership and management positions in Vietnam

Civil servants holding leadership or management positions who meet one of the following criteria shall be classified as failing to complete their tasks:

- There are signs of deterioration in political ideology, morality, lifestyle, self-evolution, and self-transformation according to the assessment of competent authorities;

- Failing to meet more than half of the criteria for the outcomes of task performance as prescribed by law, according to the set plan, or according to the assigned specific tasks;

- The agency, organization, unit or field of work assigned to fulfill less than 50% of the targets and tasks;

- Agencies, organizations and units directly under their respective management and responsibility for embezzlement, corruption and wastefulness and shall be handled in accordance with law.

- Violations in the course of task performance will be disciplined in the evaluation year.

3. Criteria for grading the quality of public employees for completing tasks in Vietnam

* For public employees who do not hold managerial positions in Vietnam

An employee who does not hold a managerial position with one of the following criteria shall be classified as failing to complete the task:

- There are signs of deterioration in political ideology, morality, lifestyle, self-evolution, and self-transformation according to the assessment of competent authorities;

- Having more than 50% of the criteria on the results of task performance according to the signed working contract, according to the proposed plan or according to the assigned specific tasks, which fail to ensure the progress, quality and efficiency;

- Violations in the course of task performance will be disciplined in the evaluation year.

* For administrative officers in Vietnam

Managerial officers who meet one of the following criteria shall be classified as failing to fulfill their duties:

- There are signs of deterioration in political ideology, morality, lifestyle, self-evolution, and self-transformation according to the assessment of competent authorities;

- Having more than 50% of the criteria on the results of task performance according to the signed working contract, proposed plan, or assigned specific tasks that fail to ensure progress, quality, and efficiency;

- The unit or field of work assigned to complete less than 50% of the targets and tasks.

- Units under their charge and management that are directly related to embezzlement, corruption, and waste and are handled in accordance with the law.

- Violations in the course of task performance will be disciplined in the evaluation year.
