Vietnam: Cases eligible for early retirement of officials, public employees and workers in 2020

Officials, public employees and workers are entitled to early retirement according to the provisions of the law. So, what are the conditions for early retirement, and how much pension will be received? LawNet will answer in the following article.

Case 1: Employees defined at Points a, b, c, d, g, h and i, Clause 1, Article 2 of the Social Insurance Law 2014 of Vietnam who have paid social insurance premiums for at least full 20 years are entitled to pension when falling in one of the following cases:

Suffer a working capacity decrease of 81% or more

Full 45 years old

Having full 15 years doing heavy, hazardous or dangerous occupations or jobs or extremely heavy, hazardous or dangerous occupations or jobs on the list jointly issued by the Ministry of Labor, War Invalids and Social Affairs and the Ministry of Health, or having full 15 years working in areas with a region-based allowance coefficient of 0.7 or higher

Full 55 years old to full 60 years old

Full 50 years old to full 55 years old

Have paid social insurance premiums for at least full 20 years, including full 15 years spent in coal mines

Full 50 years old to full 55 years old

In addition to the above cases, if male and female workers meet one of the following conditions, they will be able to retire early without considering their age:

- Suffering a working capacity decrease of 61% or more and having full 15 years doing extremely heavy, hazardous or dangerous occupations or jobs on the list jointly issued by the Ministry of Labor, War Invalids and Social Affairs and the Ministry of Health;

- People infected with HIV/AIDS due to occupational accidents.

Case 2: Employees defined at Points dd and e, Clause 1, Article 2 of the Social Insurance Law 2014 of Vietnam who cease working after having paid social insurance premiums for at least full 20 years, are entitled to pension when falling in one of the following cases:

Having full 15 years doing heavy, hazardous or dangerous occupations or jobs or extremely heavy, hazardous or dangerous occupations or jobs on the list jointly issued by the Ministry of Labor, War Invalids and Social Affairs and the Ministry of Health, or having full 15 years working in areas with a region-based allowance coefficient of 0.7 or higher

Full 50 years old to full 55 years old

Full 45 years old to full 50 years old

Suffer a working capacity decrease of 61% or more

Full 50 years old

Full 45 years old

In addition to the above cases, if male and female workers meet one of the following conditions, they will be able to retire early without considering their age:

- Being full 55 years old, for men, or full 50 years old, for women, unless otherwise provided by the Law on Officers of the Vietnam People’s Army, the Law on People’s Public Security or the Law on Cipher.

- Employees who are infected with HIV/AIDS due to occupational risks.

- Suffering a working capacity decrease of 61% or more and having full 15 years doing extremely heavy, hazardous or dangerous occupations or jobs on the list jointly issued by the Ministry of Labor, War Invalids and Social Affairs and the Ministry of Health.

Case 3: Officials and public employees retiring early according to downsizing policy:

Paying social insurance premiums for at least 20 years
