Vietnam's Instruction 36-HD/BTCTW stipulates the age of candidates for People's Council deputies for the term 2021–2026 as follows:

- Cadres, civil servants, and public employees who run for the full-time People's Council election for the first time must be old enough to serve two or more terms of the People's Council or at least one full term, specifically:

+ A male born in February 1966;

+ Female students from January 1971 onwards.

- The re-elected personnel must be of working age for at least 1/2 of the term (30 months) or more from May 2021, specifically:

+ A male born in August 1963;

+ Female students born in July 1968 or later who will retire when they reach the Labor Code retirement age in 2019.

Note: Particularly for candidates for People's Council deputies who are army and public security officers, they must comply with the age limits specified in the Law on Officers of the Vietnam People's Army and the Law on People's Public Security.

- Cases of older age candidates, such as members of the Party Central Committee and leaders of associations according to Vietnam's Conclusion No. 58-KL/TW dated September 12, 2019 of the Secretariat, shall be considered and decided by the competent authority managing the staff.

- Specifically, female cadres who retire at an older age according to the government's decree shall be counted as how it is for male cadres.

The candidate, for the first time, was born in January 1966;

The person who was re-elected was born in July 1963 or later and will retire when he reaches the prescribed age.

In addition to the age criteria, the person nominated to be a full-time member of the People's Council at all levels must also meet the following criteria and conditions:

- Having a university degree or higher (for the province and district level).

- At the provincial level, a full-time deputy chairperson of the People's Council must be a member of the province or more (including one comrade who is a member of the standing committee), holding a position from the director of a department or equivalent or higher and have been planned as vice president of the People's Council, vice president of the People's Committee of the province or higher; the candidate for the head of a full-time section of the People's Council must hold the position of deputy director of the department or equivalent or higher; candidates for full-time deputy heads of the People's Councils must hold positions from department heads or equivalent in departments, divisions, and branches at the provincial level or higher.

- At the district level: the full-time deputy chairperson of the People's Council must be a district member, hold the position of department head or equivalent at the district level or higher and have been planned as a vice president of the People's Council; vice presidents of the People's Committees of districts or higher; cadres who stand for head of a full-time section of the People's Council must hold the position of deputy head of the division or equivalent at the district level or higher; the candidate for deputy head of the People's Council must have held the rank of specialist for 5 years or more and have been planned to hold the position of deputy head of a division or equivalent at the district level or higher.

For the comrades who are expected to be appointed as heads of committees of the provincial and district People's Councils concurrently, it is necessary to have the capacity, qualifications, health, and time to meet the job requirements.

- At the commune level, the full-time cadres to run for vice president of the People's Council must be members. Based on the specific situation, the Standing Committee of the Provincial Party Committee and the City Party Committee shall provide specific guidance on criteria and conditions for cadres to run for the position of vice president of the commune-level full-time People's Council.

- Regarding health standards: being certified as healthy by a competent health agency within a period of no more than 06 months to May 2021 (province party committee, city party committee to guide and identify medical facilities for mosaicking health)
