Use of Unqualified Teachers May Result in a Fine of Up to VND 50 Million

This continues to be one of the noteworthy contents in the Draft Decree stipulating sanctions for administrative violations in the field of education to replace Decree 138/2013/ND-CP, which is currently being circulated for comments.

Specifically, this Draft Decree stipulates the fines for violations of regulations regarding the use of educators as follows:

- A fine from 5,000,000 VND to 10,000,000 VND for using educators who do not meet the standards in preschool, general education, and continuing education institutions;

- A fine from 10,000,000 VND to 20,000,000 VND for using educators who do not meet the standards in vocational, intermediate, and college-level institutions that train teachers;

- A fine from 30,000,000 VND to 40,000,000 VND for using educators who do not meet the standards in higher education institutions, academies, and institutions authorized to offer doctoral programs;

- A fine from 40,000,000 VND to 50,000,000 VND for using educators who do not comply with the professional or language proficiency standards in teaching educational programs, foreign-affiliated training programs, or programs at foreign-invested educational institutions; in organizing foreign-language certificate exams.

It is clear that the Draft Decree has significantly increased the penalties for violations regarding the use of educators. Currently, Decree 138/2013/ND-CP stipulates, for using educators who do not meet the standards in preschool and general education, the fine ranges from 2,000,000 VND to 6,000,000 VND; for using educators who do not meet the standards in higher education, the fine ranges from 4,000,000 VND to 10,000,000 VND; and for using educators who teach foreign-influenced education programs without complying with professional and language proficiency standards, the fine ranges from 10,000,000 VND to 20,000,000 VND.

Additionally, the Draft also inherits the penalties for violations of regulations regarding policies for educators or acts that insult the honor and dignity or infringe the physical integrity of educators and education management officers as previously stipulated in Decree 138, as follows:

- A fine from 2,000,000 VND to 4,000,000 VND for failing to comply with the professional and vocational training requirements for educators.

- A fine from 5,000,000 VND to 10,000,000 VND for acts that insult the honor and dignity or infringe the physical integrity of educators, education management officers, and other laborers in educational institutions. (The Draft adds the subject "other laborers in educational institutions" compared to Decree 138).
