According to Article 6 Decree 56/2015/ND-CP, Section IV Guidance 1326/HD-UBDT, the results of evaluation and classification of officials and public employees are an important basis for placement, usage, training, fostering, upgrading or promotion of professional titles, planning, appointment, dismissal, transfer, rotation, reward, discipline, and implementation of other policies concerning officials and public employees.
For officials, the evaluation and classification results are used according to the provisions of Clause 3 Article 29 and Clause 3 Article 58 of the Law on Cadres and Civil Servants. To be specific:
- Officials who for 2 consecutive years complete tasks but show limited capability, or for 2 consecutive years, 1 year complete tasks but show limited capability and 1 year fail to complete tasks, the competent agency, organization shall reassign the task.
- Officials who for 2 consecutive years fail to complete tasks, the competent agency, organization shall dismiss them, release them from tasks.
For civil servants, the evaluation and classification results are used according to the provisions of Clause 3 Article 29 and Clause 3 Article 58 of the Law on Cadres and Civil Servants and Section IV Guidance 1326/HD-UBDT. To be specific:
- Civil servants who for 2 consecutive years complete tasks but show limited capability, or for 2 consecutive years, 1 year complete tasks but show limited capability and 1 year fail to complete tasks, the competent agency, organization, unit shall reassign the task.
- Civil servants who for 2 consecutive years fail to complete tasks, the competent agency, organization, unit shall resolve job termination.
For public employees, the evaluation and classification results are used according to the provisions of Point a Clause 1 Article 29 of the Law on Public Employees and Section IV Guidance 1326/HD-UBDT. To be specific, public employees who for 2 consecutive years are rated at the level of not completing tasks, the unit shall unilaterally terminate the working contract.
