According to the latest Official Dispatch dated February 19, 2021 of the Government Inspectorate, officials and civil servants must complete the declaration and publicize the first declaration of assets and income before March 31, 2021.

Specifically, according to the guidance in Official Dispatch 252/TTCP-C.IV on controlling assets and income issued by the Government Inspectorate on February 19, 2021, agencies, organizations, and units shall make a list of people holding positions specified in Clauses 1, 2 and 3, Article 34 of the Anti-Corruption Law to request the first declaration of assets and income; The person obliged to declare submits 02 declarations to the agency, organization, or unit that manages and employs the person obliged to declare in accordance with the provisions of the Anti-Corruption Law and Decree 130/2020/ND-CP.

The declaration and publication of the above-mentioned initial declaration of assets and income must be completed before March 31, 2021.

Note that in this round, only the first declaration of assets and income will be made. The annual declaration and additional declaration for 2021 will be carried out at the end of 2021, ensuring completion before December 31, 2021, in accordance with the provisions of the Anti-Corruption Law.

In cases where assets and income must be declared to serve staff work but the person has not declared assets and income for the first time according to the provisions of the Anti-Corruption Law 2018, then make the first declaration of assets and income and use the first declaration to serve staff work at that time.

Subjects thay must complete a declaration of assets and income before March 31, 2021 in Vietnam

According to the instructions in this Official Dispatch as well as the provisions in Clauses 1, 2 and 3, Article 34 of the Law on Anti-Corruption 2018, the following subjects must complete their asset and income declarations before March 31, 2021:

(1) Officials and civil servants.

(2) People's Public Security officers; People's Army officers; professional soldiers.

(3) People holding positions as Deputy Head of Department or equivalent or higher working at public service units or enterprises with 100% charter capital held by the State, person appointed to represent state capital at the enterprise.

Assets and income that must be declared in Vietnam

According to the provisions of Article 35 of the Anti-Corruption Law 2018, assets and income of officials and civil servants that must be declared include:

- Rights to use land, houses, construction works, and other assets attached to land, houses, construction works;

- Precious metals, gemstones, money, valuable papers, and other movable assets, with each asset valued at VND 50,000,000 or more;

- Assets and accounts abroad.

Note: In cases where officials and civil servants who are subject to declaring assets and income dishonestly explain the origin of assets and additional income dishonestly, depending on the nature and severity of the violation, disciplinary action will be taken in the form of a warning, salary reduction, demotion, dismissal, or dismissal if they are planned for leadership or management positions; they will be removed from the planning list; In cases of a request to quit duty, resign, or be relieved of duty, disciplinary action may not be considered.
