Below is noteworthy content from Circular 6/2020/TT-BNV regarding Regulations on organizing recruitment exams, admissions for officials and public employees, promotion exams for officials, exams or admissions to promote professional titles for public employees; Regulations on recruitment exams, admissions for officials and public employees, promotion exams for officials, exams or admissions to promote professional titles for public employees issued by the Minister of Home Affairs of Vietnam on December 2, 2020.

Circular 6/2020/TT-BNV will officially take effect from January 20, 2021. From this point, the recruitment exams, exam-based and review-based recruitment of officials and public employees, promotion exams for officials, exams or reviews for upgrading public employee professional titles in Vietnam will be conducted in accordance with the new Regulations in this Circular. Specifically, Article 2 of Circular 6/2020/TT-BNV provides guidance on handling violations regarding candidates as follows:
1. Reprimand:
Proctors in the exam room shall make a report, publicly announce it in the exam room, and apply it to candidates who commit one of the following violations:
- Intentionally sitting in the wrong seat as per their registration number;
- Communicating with other candidates despite having been warned;
- Bringing into the exam room mobile phones, recorders, cameras, computers, technical communication devices, data storage tools, other information transmission devices, and any papers or documents related to the exam content (unless otherwise prescribed in the exam paper).
2. Warning:
Proctors in the exam room shall make a report, publicly announce it in the exam room, and apply it to candidates who commit one of the following violations:
- Sharing answers or drafts with other candidates;
- Allowing other candidates to copy their answers or copying from other candidates;
- Using materials, mobile phones, recorders, cameras, computers, and other information transmission devices in the exam room (unless otherwise prescribed in the exam paper).
3. Test Disqualification:
The Head of the Examination Committee decides on test disqualification for candidates who have been reported for warnings but continue to violate exam regulations or candidates who intentionally disrupt safety and order in the exam room.
The test disqualification is publicly announced in the exam room.
4. Test Result Cancellation:
Based on the report of the Chairman of the Examination Council, the head of the authorized recruitment organization, promotion exams for officials, or upgrading public employee professional titles cancels the test results for candidates who commit one of the following violations:
- Writing or drawing on the test papers content unrelated to the exam content;
- Substituting or receiving substitution in exams, or being disqualified.
5. Deduction of Test Scores:
- Candidates reprimanded during any part of the exam, test, or subject will have 25% of the total number of correct answers or 25% of the total score of that part, test, or subject deducted.
- Candidates warned during any part of the exam, test, or subject will have 50% of the total number of correct answers or 50% of the total score of that part, test, or subject deducted.
- When combining the candidates' work and grading, based on the report on violations made by the proctors, the Secretary of the Examination Council reports to the Chairman of the Council for consideration and decision on score deduction for the two cases mentioned above.
6. Zero Score for Multiple-Choice or Written Exams:
The Head of the Examination Committee decides on giving a zero score based on the written report from the examiners, applying to one of the following cases:
- The part of the exam, test, or subject has more than one set of answers;
- The part of the exam, test, or subject has two or more different handwriting styles;
- The part of the exam, test, or subject is written using two or more different ink colors or inks not conformable to Clause 6, Article 1 of these Regulations, unless there is a confirmation report from the proctors in the exam room and the Head of the Examination Committee;- The part of the exam, test, or subject is written on scrap paper or paper not distributed by the proctors in the exam room.
Note:
- Violating candidates must have a report made, signed by both the violating candidate and the proctors in the exam room. After making the report and publicly announcing it in the exam room, the proctor must immediately report to the Head of the Examination Committee.
In the event the violating candidate refuses to sign the violation report, the proctor shall invite two adjacent candidates to sign to confirm the incident. If one or both of the invited candidates refuse to sign, the proctor still makes the report and reports to the Head of the Examination Committee for review and decision.
- Candidates who intentionally disrupt safety and order in the exam room, besides being disqualified and having their test results canceled, may also be handled according to criminal law depending on the nature and extent of the violation.
- Candidates who are officials and public employees, if disqualified or have their test results canceled, the head of the managing authority considers disciplinary action as per the law on officials and public employees.
Thus, from January 20, 2021, if a candidate's exam part has two or more different handwriting styles, it will be given zero points for that exam part. Besides, if the exam part has more than one set of answers OR is written with two or more different ink colors or inks not conformable OR is written on scrap paper or paper not distributed by the exam room proctors, that exam part will also be given zero points. Furthermore, candidates, and officials and public employees taking part in the exam should adhere to the exam regulations, review-based recruitment of officials and public employees, promotion exams for officials, and upgrading public employee professional titles as stipulated in Circular 6/2020/TT-BNV to avoid unfortunate handling.
