First, are agencies, units, and enterprises required to provide Tet bonuses to employees?
For officials, according to Clause 2, Article 12 of the Law on Cadres and Civil Servants 2008 regarding the rights of officials to salaries and related policies, officials are entitled to overtime pay, night work pay, travel allowances, and other policies as prescribed by law.
For public employees, Clause 3, Article 12 of the Law on Public Employees 2010 also stipulates that public employees are entitled to bonuses as prescribed by law and the regulations of the public service provider.
For workers in general and those working in private enterprises in particular, Article 103 of the Labor Code 2012 states that bonuses are amounts given by the employer to employees based on the annual production and business results and the level of job completion of the employees. The bonus regulations are decided by the employer.
Thus, according to the above regulations, state agencies, public service providers, and enterprises are not required to provide Tet bonuses to their employees. The Tet bonus is decided by the agencies, units, and enterprises based on their financial resources, revenue, and the working efficiency of each official, public employee, and worker.
Second, will the Tet bonus for officials and public employees in 2020 be higher than that for workers in enterprises?
As analyzed above, the law does not stipulate that agencies, units, and enterprises must provide Tet bonuses to employees. The Tet bonus will be decided by each agency, unit, and enterprise, and thus the amount of the Tet bonus will also vary.
Therefore, it is difficult to answer the question regarding the difference in Tet bonuses between workers in private enterprises and those in state agencies or public service providers, as each place will have a different bonus level depending on their conditions.
For example:
In the private sector, many banks offer average employee bonuses ranging from 3 to 4 months' salary (ranging from 30 to 60 million VND). However, in 2016, the Saigon Shoe Joint Stock Company announced a Tet bonus for workers that included 10 kg of rice, 1 bunch of bananas, and 1 kg of pork.
In the state sector, in 2018, for the Huong Duong Kindergarten in Hoc Mon District, Ho Chi Minh City, each teacher received 30 million VND (including Tet bonus and additional year-end income). Meanwhile, teachers at Thach Binh Primary School in the mountainous district of Thach Thanh (Thanh Hoa) only received Tet wishes as their bonus.
