1. Who are market surveillance officers?

According to Clause 1, Article 10 of the Ordinance on Market Surveillance 2016, market surveillance officers are recruited as per the laws on state officials, undergo professional training and have professional titles for market surveillance officers.

Specifically, the market surveillance officers’ titles include:

- Senior market controller;

- Chief market controller;

- Market controller;

- Middle-ranked market controller:

2. Standards of market surveillance officers in Vietnam

2.1. General standards of political, ethical, and lifestyle qualifications of market surveillance officers in Vietnam

Specifically, in Article 4 of Circular 02/2022/TT-BCT, general standards on political qualities, ethics and lifestyle of market surveillance officers in Vietnam are prescribed as follows:

Having a strong political opinion and courage consistent with Marxism-Leninism and Ho Chi Minh's thought; firmly grasping the party's guidelines, lines, and regulations as well as the state's policies and laws; being loyal to the fatherland and abiding by the Constitution of the Socialist Republic of Vietnam; and protecting the nation's, people's, and people's interests.

- Fully fulfilling civil servants' legal obligations; complying with the law; maintaining discipline and administrative discipline; following superiors' task assignments; and modeling the implementation of the agency's internal rules and regulations.

- Dedication, responsibility, integrity, honesty, objectivity, fairness, and exemplary conduct in performing official duties; politeness, culture, and standards in communicating with and serving the people.

- Having a healthy, modest, and united lifestyle and activities; needing thrift, integrity, righteousness, justice, and impartiality; not taking advantage of public affairs to seek personal benefits; and avoiding bureaucracy, corruption, wastefulness, and negativity.

- Regularly having a sense of learning and training to improve political qualities, lifestyle ethics, public service ethics, qualifications, and capacity.

2.2. Standards on training and retraining qualifications of market surveillance officers in Vietnam

* Senior market controller

- Having a university degree or higher with a major relevant to the field of operation of the market management force;

- Having an advanced diploma in political theory or an advanced degree in political - administrative theory or a certificate of political theory level equivalent to advanced political theory issued by a competent authority;

- Having a certificate of state management knowledge training for civil servants holding the rank of senior and equivalent specialists.

* Chief market controller

- Having a university degree or higher with a major relevant to the field of operation of the market management force;

- Having a certificate of state management knowledge training for civil servants holding the rank of main specialist and equivalent.

* Market controller

- Having a university degree or higher with a major relevant to the field of operation of the market management force;

- Having a certificate of state management knowledge training for civil servants holding the rank of specialist and equivalent.

* Middle-ranked market controller: Having a college degree or higher with a major relevant to the field of operation of the market management force.

3. Occupational prohibitions bound by market surveillance officers in Vietnam

Market management officers are not allowed to perform the following acts:

- It is prohibited to conduct inspections and professional measures unfounded or contrary to functions, authority, scope of missions and operation areas assigned and to the laws.

- It is prohibited to hinder the circulation of goods and entities' trading of legitimate merchandise and commercial services. It is prohibited to threaten, bribe or deceive entities upon inspections or settlement of administrative infractions.

- It is prohibited to abuse powers and positions to harass violators or exact money or items from them. It is prohibited to abet or screen perpetrators of administrative infractions and restrict their rights upon the settlement of such infractions. It is prohibited to display attitudes, gestures or verbal expressions against regulations towards organizations and individuals during the enforcement of public assignments.

- It is prohibited to disclose information or documents related to inspection activities of market surveillance units in unauthorized manner.

- It is prohibited to perform activities inhibited by laws on state officials.
