Regulations on Guidelines for Implementation of Rank Promotion Review for Officials

To be specific: This regulation is specified in the Officer Law and the Amended Official Law 2019. The Draft Decree has supplemented regulations on the process of implementing the position promotion assessment in Article 38. The position promotion assessment for officials is conducted as follows:

- Based on the registration dossier for promotion assessment, the official position promotion assessment committee checks the standards and conditions of the officials participating in the promotion assessment according to the provisions in Clause 5, Article 32 of this Draft, and reports the results to the Promotion Council no later than 02 working days after completing the standard and condition inspection for the promotion assessment;

- No later than 02 working days after receiving the inspection results report, the Promotion Council must hold a meeting to agree on the promotion assessment results and report to the head of the authority competent to organize the position promotion for officials, including the list of officials who passed the promotion assessment session (if any);

- No later than 05 working days from the date of announcing the promotion assessment results, the Promotion Council continues to organize the promotion examination for officials in case there are still promotion quotas for officials;

- The results of the promotion assessment are publicly announced at the authority organizing the promotion;

- The authority competent to organize the position promotion for officials has the right to cancel the promotion assessment results and not recognize the promotion assessment if it is found that the officials do not meet the standards and conditions for the promotion assessment.

Note, the promotion of officials must be based on the job position, matching the official position structure of the official-using agency approved by the competent authority.
