Regular salary increase regime for civil servants and public employees in Vietnam (Internet image)
Subjects specified in Clause 1, Article 1 of Circular 08/2013/TT-BNV, if the final salary level has not been ranked in the civil servant rank, in the civil servant professional title, senior expert title, and current professional and professional title in the Court and Procuracy sectors, will be considered for a regular salary increase when you have enough time to hold the rank or position and meet the criteria for a regular salary increase specified in Clause 1 and Clause 2, Article 2 of Circular 08/2013/TT-BNV during the period of maintaining the salary level as follows:
1. Conditions for holding a rank in a rank or position to consider regular salary increases
- Time to hold rank for regular salary raise consideration:
+ For senior expert positions: If they have not ranked the last salary level in the senior expert salary schedule, then after 5 years (full 60 months) holding the salary level in the senior expert salary schedule, they will be considered for a salary increase;
+ For ranks and titles that require college education or higher: If the final salary level in the rank or position has not been ranked, then after 3 years (full 36 months) of holding the salary level in the rank or position, the salary level will be considered for an increase;
+ For ranks and positions requiring intermediate or lower training levels and executive and service staff: if they have not ranked the last salary level in the rank or title, then after 2 years (full 24 months) holding the salary level in the rank or title, they will be considered for a salary increase.
- Cases that count towards the time to consider regular salary increases include:
+ Time off from work is paid with a full salary according to the provisions of labor law;
+ Maternity leave period according to the provisions of the law on social insurance;
+ The cumulative period of leave for sickness, labor accident, or occupational disease covered by social insurance is 6 months or less (during the period of holding the rank) according to the provisions of the law on social insurance;
+ The time when the competent authority decides to send you to work as an expert, study, practice, work, or survey domestically or abroad (including the time spent following the wife and husband regime according to Government regulations) but still on the agency or unit's salary list;
+ Duration of officers, civil servants, public employees, and workers participating in active military service according to the Law on Military Service.
2. Time is not counted to consider regular salary increases in Vietnam
Time not counted for regular salary increase consideration includes:
- Unpaid personal leave time;
- The time spent working as an expert, studying, interning, working, or conducting surveys at home and abroad exceeds the time limit decided by the competent authority;
- Time of work suspension, detention, temporary detention, and other types of non-working time other than those specified in Point b, Clause 1 of this Article;
- Probation period (including cases of receiving 100% of the salary of the civil servant rank or professional title of probationary officer).
- Time spent by cadres, civil servants, public employees, and workers deserting during active military service.
- Probation period for cadres, civil servants, public employees, and workers sentenced to imprisonment but suspended sentences; in case the probationary period is less than the extended period of regular salary increase, it will be calculated according to the extended period of regular salary increase.
- Time off work to wait for full retirement age according to the current provisions of law.
The total of all types of time that are not counted to consider a regular salary increase (if any) is calculated as a full month. If there is an odd period of time that is not a full month, it is calculated as follows: Less than 11 working days (excluding weekly holidays and days off with full pay according to labor laws) are not counted; 11 working days or more is calculated as 01 month.
3. Standards for regular salary increases for civil servants and public employees in Vietnam
Subjects specified in Clause 1, Article 1 of Circular 08/2013/TT-BNV are eligible to hold the rank or title specified in Clause 1, Article 2 of Circular 08/2013/TT-BNV for a period of time, and through assessment of meeting the following 2 standards during the period of holding the salary level, they will be regularly upgraded by one salary level:
- For officials and civil servants:
+ Standard 1: assessed and graded by competent authorities at a level of task completion or higher;
+ Standard 2: Do not violate discipline in any of the forms of reprimand, warning, demotion, or dismissal.
- For officials and employees:
+ Standard 1: Evaluated by competent authorities from the level of task completion upwards;
+ Standard 2: Do not violate discipline in any of the forms of reprimand, warning, or dismissal.
4. Extended time for considering regular salary increases for civil servants and public employees
During the period of maintaining the current salary level, if officers, civil servants, public employees, and employees have been notified or decided in writing by the competent authority not to complete their assigned annual tasks or are disciplined in one of the forms of reprimand, warning, demotion, or dismissal, the time for calculating regular salary increases will be extended compared to the time specified in Point a, Clause 1, Article 2 of Circular 08/2013/TT-BNV, which is as follows:
- Lasts 12 months for the following cases:
+ Officials are disciplined and dismissed;
+ Civil servants are disciplined, demoted, or dismissed;
+ Officials and employees are disciplined and dismissed.
- Lasts 06 months for the following cases:
+ Officials, civil servants, and workers are disciplined, reprimanded, or warned;
+ Officials receive disciplinary warnings;
+ Officials, civil servants, public employees, and workers are assessed and graded by competent authorities at the level of failure to complete their assigned tasks every year; If during the period of holding the rank there are 02 non-consecutive years of not completing the assigned tasks, then each year of not completing the assigned tasks will be extended by 06 months.
- Lasts 3 months for officials who are disciplined and reprimanded.
In the case of both being evaluated and ranked for quality at the level of not completing assigned tasks and being disciplined, the extended time for a regular salary increase is the sum of the above extended times.
In cases where the quality is evaluated and ranked at the level of not completing the task due to disciplinary action (same violation), the extended time for regular salary increases is calculated according to the corresponding disciplinary form.
In cases where cadres, civil servants, public employees, and workers who are Party members are subject to Party discipline: if there has been an administrative disciplinary decision, the time for regular salary increases will be extended in the form of administrative discipline; If there is no administrative disciplinary decision, the period of regular salary increases will be extended according to the form of Party disciplinary action corresponding to the forms of administrative disciplinary action specified in this Clause.
Note: In case there has been a conclusion from a competent authority that it is unjust or wrong after being suspended from work, detained, or disciplined (reprimand, warning, demotion, dismissal), during this period, regular salary increase regimes will be recalculated as follows:
- The time of being suspended from work, temporarily detained, or temporarily detained due to wrongful reasons will be counted back into the time to consider salary increases;
- Do not extend the time to consider salary increases for unjust or wrongful disciplinary forms.
- Receive back wages and pay social insurance (including social insurance paid by agencies and units) according to recalculated salary levels.
