Recruitment Methods for Officials According to New Regulations (Draft)

Draft Law amending and supplementing a number of articles of the Law on officials and the Law on public employees amends an issue of interest to any worker wanting to work in state agencies, which is the recruitment method for officials.

If Article 37 of the 2008 Law on Officials and Public Employees outlines two basic methods as follows:

- Recruitment of officials is conducted through examination;- Individuals meeting the conditions stipulated in Clause 1, Article 36 of this Law who voluntarily commit to working for 5 years or more in mountainous, border, island areas, remote regions, areas with ethnic minorities, or areas with particularly difficult socio-economic conditions, are recruited through selection.

The Draft Amended Law on Officials and Public Employees now introduces the following new points:

- Recruitment of officials is conducted through examination or selection, ensuring the selection of individuals with integrity, qualifications, and capabilities;- Selection includes, in addition to the voluntary commitment to work for 5 years or more in mountainous, island areas, remote regions, areas with ethnic minorities, or areas with particularly difficult socio-economic conditions, policies to attract and create sources of officials from outstanding graduates, young scientists, and most recently, the recruitment of exceptionally talented individuals.

Moreover, the head is authorized to accept an individual as an official under the following circumstances:

- The individual has at least 5 years of experience in a position requiring university-level education or higher, suitable for the mandatory job position, including: public employees, commune-level officials, salaried personnel in the armed forces, personnel in cryptographic work, those holding titles or positions in state enterprises, etc.;- Officials from the district level or higher subsequently deployed by competent authorities;- Acceptance of these officials for appointment to leadership or management positions from the department level or higher means that the acceptance and appointment decision simultaneously serves as the recruitment decision for officials.

Emphasizing the qualifications and experience of candidates also demonstrates the attention to nurturing individuals working in agencies and the leadership and management apparatus of the public service provider within the Communist Party of Vietnam, the State, and socio-political organizations.

More details can be found in the Draft Amended Law on Officials and Public Employees 2019, expected to take effect on January 1, 2020.
