This is the content of the draft Decree regulating retirement at an older age for cadres and civil servants holding leadership and management positions.
Proposing to increase the retirement age for leading and managerial cadres and civil servants (Artwork)
Accordingly, the draft Decree stipulates the retirement at an older age for cadres and civil servants holding leadership and management positions in the following two groups:
- The first group is female cadres and civil servants holding the following positions and titles:
+ Deputy Head of Party Committees and agencies at the Central Committee, Deputy Director of Ho Chi Minh National Academy of Politics, Deputy Editor-in-Chief of Nhan Dan Newspaper, Deputy Editor-in-Chief of Communist Review;
+ Vice Chairman of the Central Committee of the Vietnam Fatherland Front;
+ Vice Chairman of the Council of Ethnic Minorities, Vice Chairman of Committees of the National Assembly, Deputy Chairman of the Office of the National Assembly, Deputy State Auditor General;
+ Deputy Chief Justice of the Supreme People's Court, Deputy Head of the Supreme People's Procuracy;
+ Deputy ministers and deputy heads of ministerial-level agencies;
+ Deputy heads of socio-political organizations at the central level; Deputy Secretary of the Party Committee of the block under the Central Government; Member of the Central Commission for Inspection;
+ Director of National Political Publishing House, President of Vietnam National University, Hanoi, President of Vietnam National University, Ho Chi Minh City, General Director of Vietnam Social Security, Head of Mausoleum Management Board President Ho Chi Minh, Chairman of the National Financial Supervision Commission;
+ Officers in the armed forces with the rank of general;
+ Deputy Secretary of the Provincial Party Committee and Party Committee; Presidents of People's Councils, Presidents of People's Committees of provinces and centrally run cities;
+ Vice Chairman of the People's Council, Vice Chairman of the People's Committee of Hanoi and Ho Chi Minh City;
+ Member of the Standing Committee and Head of Party Committees of the Party Committees of Hanoi and Ho Chi Minh City;
+ A member of the Standing Committee of the Provincial Party Committee and the City Party Committee is an ethnic minority.
- The second group is civil servants who are appointed to the titles of Judges of the Supreme People's Court and Procurators of the Supreme People's Procuracy.
In addition, the draft Decree proposes 2 options for retirement age for female deputy ministers and equivalent:
- Option 1 : Keeping as current regulations is no more than 60 years old, because in fact, in these cases, the retirement age regulation was applied at a higher age than the general regulation on retirement age for employees.and female civil servants according to the provisions of the Labor Code 2019 .
- Option 2 : Regulating the age of no more than 62 years old and following the roadmap to adjust the retirement age for men (increasing by 3 months each year until reaching 62 years of age in 2028) according to Decree 135/2020/ND - CP .
In addition, the draft Decree adds 02 new titles to be identified as Deputy Ministers: Vice Chairman of the Central Committee of the Vietnam Fatherland Front, member of the Central Commission for Inspection.
At the same time, the Ministry of Home Affairs proposes to specify cases in which cadres and civil servants may extend their working time but are not subject to the application of this Decree, including:
- Officers holding the position of a Minister or equivalent or higher;
- Cadres and civil servants holding the position of Deputy Minister or equivalent but a member of the Party Central Committee;
- Assistants and Secretaries of Party and State leaders according to Regulation 30-QD/TW .
The retirement at an older age for these subjects shall comply with the provisions of the Party's competent authority.
