Payroll of Judges, Procurators and Court clerks in 2021 in Vietnam

According to Article 3 of the Resolution No. 86/2019/QH14, the National Assembly assigned the Government of Vietnam to consider increasing the statutory pay rate from VND 1,49 million/month to VND 1,6 million/month, and indexing mandatory retirement pension, social insurance benefits and monthly benefits (granted to persons receiving financial support from state budget) and financial initiatives granted to persons rendering meritorious revolutionary services to the increase in the statutory pay rate, from July 01, 2020.

However, due to the impact of the Covid-19 epidemic, the Politburo and the National Assembly have agreed not to adjust the statutory pay rate for officials, public employees, and the armed forces from July 01, 2020 until further notice at Conclusion No. 77-KL/TW dated June 05, 2020 and Resolution No. 122/2020/QH14 dated June 19, 2020.

Particularly, recently, according to Clause 7 Article 3 of Resolution No. 128/2020/QH14 on State Budget Estimates in 2021, the National Assembly of Vietnam has also agreed that in 2021, no adjustment to the statutory pay rate and poverty line has been made. Concurrently, also according to this Resolution, statutory pay rate, mandatory retirement pension, social insurance benefits and monthly benefits (granted to persons receiving financial support from state budget) and financial initiatives granted to persons rendering meritorious revolutionary services shall not be adjusted in 2020. Concentrating resources on the prevention and control of the Covid-19 epidemic, overcoming the consequences of natural disasters, implementing the issued social security policies, ensuring national defense, security and foreign affairs.

Thus, due to the impact of the Covid-19 epidemic, the statutory pay rate in 2021 will not increase and remain at 1,490,000 VND/month as prescribed in Decree No. 38/2019/ND-CP. Therefore, the highest salary of a judge or procurator is still 11.9 million VND.

According to the Resolution No. 730/2004/NQ-UBTVQH11, the professional salary table of the court industry and the procuracy in 2021 is as follows:

In which:

- Judges of the Supreme People's Court, Procurators of the Supreme People's Procuracy, Senior Inspectors, senior investigators with salary coefficients from 6.2 to 8.0 (Type A3).

- Judges of provincial People's Courts, Procurators of the provincial People's Procuracy, main inspectors, intermediate investigators with salary coefficients from 4.4 to 6.78 (Type A2).

- Judges of district-level People's Courts, district-level People's Procuratorates, inspectors, primary investigators and court clerks all have salary coefficients from 2.34 to 4.98 (Type A1).
