No Disciplinary Action Against Communist Party Members for Having a Third Child in the Following 07 Cases

Guidance 04-HD/UBKTTW for Implementing Certain Provisions in Regulation 102-QD/TW on the Disciplinary Actions Against Communist Party Members in Violation specifies 07 cases where no disciplinary action is taken against Communist Party members who have a third child, violating population and family planning policies:

  1. A married couple giving birth to a third child, if both or one of them belongs to an ethnic group with a population of less than 10,000 people or an ethnic group at risk of population decline (birth rate less than or equal to death rate) as officially announced by the Ministry of Planning and Investment;
  2. A married couple giving birth for the first time and having triplets or more;
  3. A married couple already having one biological child, giving birth a second time and having twins or more;
  4. A married couple giving birth for the third time or more, if at the time of birth there is only one biological child still alive, including biological children given for adoption;
  5. A married couple giving birth for the third time, if they already have two biological children but one or both children are disabled or suffer from severe non-hereditary diseases, as confirmed by the Provincial or Central Medical Examination Council;
  6. A married couple already having private children (biological children): giving birth to one or two children, if one of the two persons already has private children (biological children); giving birth to one or more children at the same time, if both persons already have private children (biological children). This regulation does not apply to cases where the two persons already have two or more children in common and the children are still alive.
  7. A mother giving birth to a third child due to unintended pregnancy, if using family planning measures that seriously affect her health (with confirmation from a district-level hospital or equivalent or higher).
