New Regulations on Standards and Conditions for Examining and Promoting Official Ranks

Law amending and supplementing a number of articles of the Law on Cadres, Officials, and the Law on Public Employees approved by the National Assembly on November 25, 2019.

This Law has made several changes in standards and conditions for promotion examinations for civil servants compared to the current provisions in the 2008 Law on Cadres and Civil Servants. Specifically, the 2008 Law on Cadres and Civil Servants briefly stipulates that the conditions for promotion examinations for civil servants are to have political qualities, ethics, competence, professional qualifications meeting the requirements of the examination grade. In contrast, the Law amending and supplementing the Law on Cadres, Civil Servants, and Public Employees specifies more clearly the standards and conditions for promotion examinations for civil servants as follows:

- Rated at the level of "completing tasks well" or higher in the working year immediately preceding the year of the promotion examination; possessing good political qualities and ethics; not under any discipline process, and not in the period of implementing regulations related to discipline;- Having the necessary capacity and professional qualifications to assume the job position corresponding to a higher civil servant rank within the same specialized field;- Possessing appropriate diplomas and certificates for the promotion examination;- Meeting the minimum length of service required for each civil servant rank.

Additionally, according to this Law, from July 1, 2020, civil servants can participate in promotion consideration in addition to promotion examinations as currently provided. (Currently, the promotion of civil servants is carried out through examinations and not consideration). Specifically, civil servants with outstanding achievements in public service during the time holding the current civil servant rank or being appointed to leadership or management positions linked to job position requirements and meeting the first three criteria mentioned above will be eligible for promotion consideration.

Furthermore, the Law amending and supplementing several articles of the Law on Cadres, Civil Servants, and Public Employees also adds one more civil servant rank compared to the current provisions. Specifically, in addition to the ranks stipulated in Clause 1, Article 42 of the 2008 Law on Cadres and Civil Servants, from July 1, 2020, an additional "other ranks as stipulated by the Government of Vietnam" will be added. Civil servant ranks will also be classified into five corresponding types:

- Type A includes those appointed to the rank of senior specialist or equivalent;- Type B includes those appointed to the rank of principal specialist or equivalent;- Type C includes those appointed to the rank of specialist or equivalent;- Type D includes those appointed to the rank of official or equivalent and staff rank.- Type for other civil servant ranks appointed as stipulated by the Government of Vietnam.
