New Regulations on Job Positions in Public Service Providers

the Government of Vietnam is Drafting a Decree on the management of job positions and the number of employees in public service providers established by competent state authorities in accordance with the law, with legal personality, providing public services, serving state management.

No Uniformity Between Job Positions and Workforce Size

This is a new principle added compared to the current regulations in Decree 41/2012/ND-CP on principles for defining and managing job positions:

- Compliance with legal regulations on managing public employees.- Job positions are determined and adjusted to fit the functions, tasks, authority, and organizational structure of the public service provider.- Job positions must be associated with corresponding professional titles and managerial roles.- Ensure scientific, objective, public, transparent, and practical relevance.- No uniformity between job positions and workforce size.

Guidelines for Managing Workforce Size in Public Service Providers

The workforce size in public service providers includes officials and public employees, and laborers working under the regulations of Decree 68/2000/ND-CP. Determining the workforce size is based on:

- For central agencies and organizations:- Functions, tasks, authority, organizational structure of each agency, organization, and unit as prescribed by competent authorities;- Job positions and job descriptions for each position;- The nature, characteristics, complexity, and scale, scope, and management subjects of the sector or field;- Professional and operational management processes;- The degree of office modernization, equipment, working tools, and application of information technology;- Actual state of managing the assigned workforce of the agency, organization, or unit.- For local agencies:In addition to the criteria for central agencies and organizations, the following factors are considered:- Population size, natural area, the economic-social development level of the locality;- The number of administrative units at district and commune levels;- Political security, social order, and safety characteristics.- For public service providers:The same criteria as for central agencies and organizations and the regulations of the Government of Vietnam on officials in the leadership and management apparatus of the public service provider.

Contents of the Annual Workforce Plan

- Report on the utilization results of the assigned workforce from the previous year, including statistical forms summarizing the current workforce size according to the guidelines;- Determine the required workforce;- Solutions for implementing the workforce size after being approved by competent authorities, projected workforce supplements, replacements, implementation of staff reduction policies, and cost estimates to implement.

Documentation includes:

- A document requesting the approval of the annual workforce plan;- A list of job positions and the workforce size for each position;- Related documents to the workforce size plan;- Summary of the workforce in agencies and public service providers with self-governing rights.
