Latest Guidelines on the Evaluation and Classification of Officials and Public Employees in 2019

Recently, the Ministry of Labor, Invalids and Social Affairs issued Official Dispatch 5090/LD-TBXH-TCCB regarding the evaluation and classification of officials, public employees, and workers in 2019.

In implementing the provisions on evaluating and classifying public officials and employees and laborers, the Ministry requests the Heads of Units to evaluate and classify public officials and employees and laborers for the year 2019 as follows:

* Principles, subjects, timing, authority, and process for evaluating and classifying public officials and employees and laborers:* Implement according to the provisions of Decree 56/2015/ND-CP, Decree 88/2017/ND-CP amending and supplementing several provisions of Decree 56/2015/ND-CP and Official Dispatch 4978/LD-TBXH-TCCB on guidance for evaluating and classifying public officials and employees and laborers. Specifically:

About principles of evaluation: The evaluation and classification of public officials and employees must ensure the following principles:

- Ensuring correct authority: Public officials and employees are evaluated by the head of the agency/unit. Whichever level or person conducts the evaluation must also carry out the classification and be responsible for their decisions.

- Evaluation must be based on assigned responsibilities, tasks, and task performance results. The evaluation should clarify strengths, weaknesses, deficiencies, and limitations of the public officials and employees' qualities, abilities, and qualifications.

- Ensuring objectivity, fairness, accuracy, without favoritism, retribution, partiality, or formalism.

- Evaluation and classification of leading and managing officials must be based on the performance results of the departments, units, and affiliated divisions under their leadership and management; evaluation and classification of managing public employees must be based on the performance results of the units under their management and responsibility.

- The task completion level of the head cannot exceed that of the department/unit (including divisions).

- In cases where public officials and employees do not complete tasks due to objective, force majeure factors, this will be considered during the evaluation and classification process.

About evaluation timing:

- Evaluation, classification of public officials and employees and laborers are conducted in December, before the annual commendation and reward consideration. For public service providers operating in education, training, and other fields where the work year ends before December, the evaluation and classification timing of public officials and employees and laborers are decided by the unit head.

- If transferring to another unit, the new unit is responsible for evaluating and classifying in combination with the feedback from the old unit (for cases with over 06 months working time at the old unit).

About evaluation authority:

- The unit head evaluates and classifies public officials and employees and laborers under their management authority (including Deputy Heads of units).

- The Minister evaluates and classifies the Deputy Ministers, heads of state management units, and public service providers under the Ministry (including heads of units under the General Department and Department).

* Based on evaluation and classification, the unit head reports the results to the Ministry, including: Official Dispatch reporting the implementation process; Summary table of evaluation results of public officials and employees and laborers; list of officials completing tasks but having limited capabilities stating reasons for limited capabilities; list of public officials and employees and laborers who did not complete tasks stating reasons for not completing tasks (according to the attached format).

For cases under the evaluation and classification authority of the Ministry (including heads of units under the Ministry, heads of units under the General Department, and Department), the unit submits the following documents: Individual evaluation and classification form; meeting minutes; written feedback from the Party committee; related documents such as scientific works, projects, topics, or initiatives effectively applied in the unit's public services recognized by the competent authority.
