This is a notable provision mentioned in Decree 167/2013/ND-CP on the regulation of administrative sanctions in the fields of security, order, social safety; prevention and control of social evils; fire prevention and fighting; and combating domestic violence.

To be specific, according to the provisions in Clause 1, Article 52 of Decree 167/2013/ND-CP:
“1. A warning or a fine ranging from 100,000 VND to 300,000 VND shall be imposed for one of the following acts:
a) Forbidding family members from leaving the house, preventing family members from meeting relatives, friends or having legal and healthy social relationships with the purpose of isolating and frequently putting psychological pressure on that member;
b) Not allowing family members to perform their right to work;
c) Not allowing family members to participate in legal and healthy social activities.”
It can be seen that if a husband prevents or forbids his wife from visiting her family for Tet with the aim of isolating or frequently putting psychological pressure on his wife, this act constitutes a violation of the law according to the provisions of Decree 167/2013/ND-CP. Therefore, this act will be fined from 100,000 VND to 300,000 VND.
Conversely, if a wife forbids her husband from going out to meet relatives and friends for the purpose of putting psychological pressure on him, she will also be subject to the same fine.
Expanding on this issue, the right to freedom of movement of citizens is one of the basic human rights. The right to freedom of movement of citizens is a constitutional right, inviolable by anyone. Article 23 of the Constitution of the Socialist Republic of Vietnam 2013 states clearly:
“Citizens have the right to freedom of movement and residence within the country, the right to go abroad and return from abroad. The exercise of these rights is prescribed by law.”
Therefore, any act of illegally preventing or forbidding citizens from exercising their rights shall be dealt with according to the law.
