Hanoi-Vietnam: New regulations on official rank promotion from July 1, 2020

Law on Amendments to Law on Vietnamese Officials and Law on Public Employees 2019 will officially take effect from July 1, 2020. There are the following new regulations on the official rank promotion applied from July 1, 2020:

1. Addition of new official rank

Clause 7 Article 1 of Law on Amendments to Law on Vietnamese Officials and Law on Public Employees 2019 supplements point e clause 1 Article 42 of the Law on Vietnamese Officials 2008. The new official rank includes the following types:

- Senior official and equivalent;

- Principal official and equivalent;

- official and equivalent;

- Officer and equivalent;

- Staff;

- Other ranks as specified by the Government of Vietnam.

2. Official rank promotion by consideration

Under Clause 8 Article 1 of the Law on Amendments to Law on Vietnamese Officials and Law on Public Employees 2019 amending Clause 1 Article 44 of the Law on Vietnamese Officials 2008, the official rank promotion must be based on the job position, under the rank structure of the agency, organization, or unit, and conducted through examination or consideration for rank promotion.

According to previous regulations, rank promotion was only conducted through examination. However, the new regulation recognizes two forms of official rank promotion as follows:

- Examination or

- Consideration.

3. Standards and conditions for taking examination or consideration for rank promotion

Under Clause 9 Article 1 of the Law on Amendments to Law on Vietnamese Officials and Law on Public Employees 2019 amending Article 45 of the Law on Vietnamese Officials 2008, the standards and conditions for examination or consideration for official rank promotion in Vietnam from July 01, 2020 are as follows:

- Be graded as having completed tasks satisfactorily or better in the work year immediately preceding the promotion exam year; possesses good political qualities and ethics; not under disciplinary action or subject to disciplinary regulations as stipulated by the Law on Vietnamese Officials;

- Be capable and qualified to take on a job position corresponding to the higher official rank within the same professional field;

- Meet the diploma and certificate requirements of the examination for the promotion to registered official rank ;

- Meet the minimum working time requirement for each official rank.

- Meet all the standards and conditions above and will be considered for official promotion in two cases:

+ Have outstanding achievements in public service during the period of holding the current official rank, recognized by a competent authority;

+ Be appointed to a leadership or management position associated with job position requirements.

4. Changes in the organization of examination or consideration for rank promotion

According to Clause 10 Article 1 of the Law on Amendments to Law on Vietnamese Officials and Law on Public Employees 2019, which amends and supplements Article 46 of the Law on Vietnamese Officials 2008 concerning examination or consideration for rank promotion, the Government of Vietnam has the authority to organize examination or consideration for rank promotion under the management decentralization of officials in the agencies of the Communist Party of Vietnam, the State, the Vietnam Fatherland Front, and socio-political organizations.

From July 01, 2020, the Ministry of Home Affairs will no longer preside and coordinate with relevant agencies and organizations to organize official promotion exams. The Government of Vietnam will organize an examination or consideration for rank promotion accordingly.

The new regulations on the official rank promotion from July 01, 2020 are specified in the above content. The recognition of official promotion through the two forms of examination and consideration for rank promotion is appropriate, and progressive, and ensures the rights of the current officials.
