Hanoi-Vietnam: Allowances applicable to professional military personnel, defense public employees and workers

Circular 162/2017/TT-BQP provides guidance on the implementation of Decree 151/2016/ND-CP on allowances applicable to military personnel, defense public employees, and workers working in agencies, units, and enterprises under the Vietnam Ministry of National Defense, effective from July 01, 2017, as follows:

Lump-sum allowance due to early retirement

- Eligible persons:

Professional military personnel, defense public employees, and workers are eligible for a Lump-sum allowance for early retirement if they are in the surplus workforce at military agencies, units, and enterprises subject to dissolution, merger, downsizing, downgrade of the organizational level, or transformation of the operational model leading to a reduction in numbers, and the Army no longer needs to allocate or cannot allocate a new position for them.

- Allowance A:

+ An allowance of 03 months of average salary for each year (full 12 months) of early retirement, calculated according to the following formula:

Allowance Amount = Number of years eligible for allowance (calculated by the duration of early retirement as per the stipulated age) x 03 months x Average monthly salary

+ An allowance of 05 months of average salary for the first 20 years of service. From the 21st year onwards, each year is given an allowance of 1/2 month of average salary, calculated according to the following formula:

Allowance Amount = {5 months + [(total number of years in service - 20 years) x 1/2 month]} x Average monthly salary

04 cases not eligible for allowance:

- Do not meet the age conditions for allowance and are not in the surplus workforce at military agencies, units, and enterprises subject to dissolution, merger, downsizing, downgrade of the organizational level, or transformation of the operational model leading to a reduction in numbers, and the Army no longer needs to allocate or cannot allocate a new position for them;

- Still able to serve the Army, and the Army still needs to allocate, use, but request early retirement;

- Disciplined by demotion, dismissal, salary downgrade, rank demotion, or stripping of military titles for professional military personnel; salary downgrade, mandatory resignation for Defense public employees, and workers;

- Study, work, or leave overseas for a period exceeding 30 days without permission from the competent authority.

Discharge allowance for professional military personnel:

professional military personnel who cease serving on active duty, who do not meet the criteria for retirement, illness benefits, or who cannot transfer to other sectors are eligible for discharge; upon discharge, they receive a Lump-sum discharge allowance calculated as follows:

Allowance Amount = Total number of years in service x 01 month of salary preceding discharge

In cases where professional military personnel have served directly in combat, supporting combat operations, or in difficult areas, or in roles with specific characteristics, they receive a lump-sum allowance based on the converted additional time.

Allowance applicable to relatives of professional military personnel, defense public employees, and workers serving in the Army who sacrifice their lives or die

Lump-sum Allowance = Total number of years in service x 01 month of salary preceding sacrifice or death

In cases where professional military personnel, defense public employees and workers served directly in combat, supporting combat operations, or worked in difficult areas, or in roles with specific characteristics before their sacrifice or death, their relatives receive a Lump-sum allowance based on the converted additional time.

Note: Relatives of professional military personnel, defense public employees and workers are not eligible for a Lump-sum allowance if:

- The professional military personnel, defense public employees and workers committed suicide;- Died as a result of violating military discipline or state law and were sanctioned by the form of stripping of military titles or compulsory resignation.
