Guidelines on Resolving Policies for Commune-Level Officials

Recently, the Ministry of Home Affairs has issued Circular 13/2019/TT-BNV providing guidance on certain regulations concerning commune-level officials and non-specialized personnel at the commune level, in hamlets, and residential groups.

For the surplus commune-level officials due to exceeding the regulation stipulated in Clause 1 Article 4 Decree 92/2009/ND-CP as amended and supplemented in Clause 1 Article 2 Decree 34/2019/ND-CP, and the surplus part-time workers due to exceeding the regulation stipulated in Clause 4 Article 2 Decree 34; for commune-level officials who do not meet the standards, the Chairman of the District People's Committee shall compile and propose to the Chairman of the Provincial People's Committee to resolve policies for these subjects as follows:

- Streamline staff according to Decree 108/2014/ND-CP and Decree 113/2018/ND-CP;

- Resolve severance policies according to the Officials Law 2008; early retirement; retirement pending full retirement age according to Decree 26/2015/ND-CP;

- Transfer and supplement to other communes, wards, commune-level towns within the district or another district within the province; or transfer to officials at the district level or higher according to Decree 161/2018/ND-CP;

- Based on Article 21 Decree 163/2016/ND-CP, the Provincial People's Committee shall present to the same level People's Council for consideration and decision on support expenditure for severance to surplus part-time commune-level workers.

In addition, This Circular also stipulates that each commune-level official position is arranged from 01 person or more, the Provincial People's Committee prescribes the arrangement for additional personnel for certain commune-level official positions in accordance with the requirements and tasks of each commune, ward, commune-level town (except for the position of Commune Police Chief and Chief Commander of the Commune Military Command) but does not exceed the total number of commune-level officials stipulated in Clause 1 Article 4 Decree 92/2009/ND-CP as amended and supplemented in Clause 1 Article 2 Decree 34.

For commune-level official positions held by 02 persons, when recruiting, recording profiles and social insurance books must be consistent with the official position titles stipulated in Clause 2 Article 3 Decree 92/2009/ND-CP.
