Decree 90/2020/ND-CP stipulates the authority, procedures, and evaluation process for rating the quality of officials and public employees as follows:

I. Authority

1. For officials

Authorities managing officials shall conduct the evaluation and rating based on their level of management.

2. For official

- The evaluation and rating of the quality of the head of an agency, organization, or unit shall be carried out by the head of the directly managing superior agency.- The evaluation and rating of the deputy head and other officials managed by the head of an agency shall be conducted by the head of that agency.

3. For public employee

The authority and responsibility to evaluate and rate the quality of public employees shall comply with Clauses 1, 2, and 3 of Article 43 of the Law on Public Employees.

II. Procedures

  1. Procedures for evaluating and rating the quality of officials

The procedure for evaluating and rating the quality of officials shall follow these steps:

- Self-evaluation and rating by the official: The official shall prepare a self-evaluation report and propose a rating based on the responsibilities and duties assigned, following Form 01 of the Appendix issued with this Decree.

- Evaluation and remarks on the official

- Organizing a meeting of the leadership collective of the agency or organization where the official works for evaluation and remarks. The official presents the self-evaluation report at the meeting, and attendees provide feedback, which must be recorded in the minutes and agreed upon at the meeting.

- The managing authority decides whether to seek comments and evaluations from relevant agencies, organizations, and units directly managed by the official.

- Collecting comments and evaluations from the party committee of the same level where the official works.

- Consideration and decision on the evaluation and rating of the official

- The personnel advisory body of the managing agency consolidates feedback and recommendations on the evaluation and rating for the official.

- The managing authority reviews and makes the final decision on the evaluation and rating of the official.

- Announcing the evaluation and rating results for the official: The managing authority announces the results in writing to the official and publicly discloses the results within the agency, organization, or unit where the official works; deciding on a public disclosure form, prioritizing electronic disclosure.

  1. Procedures for evaluating and rating the quality of official

**** For official who is the head of an agency, organization, or unit:

- Self-evaluation and rating by the official: The official prepares a self-evaluation report, proposing a rating based on responsibilities and duties assigned, following Form 02 of the Appendix issued with this Decree.

- Evaluation and remarks on the official

- Organizing a meeting at the agency, organization, or unit where the official works for evaluation and remarks.- The meeting's participants include all officials of the agency, organization, or unit.- If the agency, organization, or unit has sub-units, the participants include the collective leadership, the party committee, the trade union, the youth union, and the heads of the sub-units; in large-scale agencies, the heads of sub-units may provide written comments.- The official presents the self-evaluation report at the meeting, and attendees provide feedback, which must be recorded in the minutes and agreed upon at the meeting.

- Collecting comments and evaluations from the party committee of the agency, organization, or unit where the official works.

- Consideration and decision on the evaluation and rating of the official

- The personnel advisory body of the evaluating agency consolidates feedback and recommendations on the evaluation and rating for the official.

- The evaluating authority reviews and makes the final decision on the evaluation and rating of the official.

- The evaluating authority announces the results in writing to the official and publicly discloses the results within the agency, organization, or unit where the official works; deciding on a public disclosure form, prioritizing electronic disclosure.

*** For the deputy head and other officials managed by the head:

- Self-evaluation and rating by the official: The official prepares a self-evaluation report, proposing a rating based on the duties assigned, following Form 02 of the Appendix issued with this Decree.

- Evaluation and remarks on the official

- Organizing a meeting at the agency, organization, or unit where the official works for evaluation and remarks.- The meeting's participants include all officials of the agency, organization, or unit or the sub-unit where the official works in case of sub-units.- If the official is a deputy head of an agency with sub-units, the participants include the collective leadership, the party committee, the trade union, the youth union, and the heads of the sub-units; in large-scale agencies, the heads of sub-units may provide written comments.- The official presents the self-evaluation report at the meeting, and attendees provide feedback, which must be recorded in the minutes and agreed upon at the meeting.

- Collecting comments and evaluations from the party committee of the agency, organization, or unit where the official works.

- Consideration and decision on the evaluation and rating of the official

- For the deputy head, the head of the agency, organization, or unit reviews the feedback and related materials (if any) to make the final evaluation and rating decision.- For other officials managed by the head, the head of the agency, organization, or unit decides based on feedback provided during the evaluation meeting.

- The evaluating authority announces the results in writing to the official and publicly discloses the results within the agency, organization, or unit where the official works; deciding on a public disclosure form, prioritizing electronic disclosure.

  1. Procedures for evaluating and rating the quality of public employee

*** For public employee who is the head and the deputy head:

- Self-evaluation and rating by the public employee: The public employee prepares a self-evaluation report, proposing a rating based on responsibilities and duties assigned, following Form 03 of the Appendix issued with this Decree.

- Evaluation and remarks on the public employee

- Organizing a meeting at the unit where the public employee works for evaluation and remarks. The meeting's participants include all public employees of the unit.- If the unit has sub-units, the participants include the collective leadership, the party committee, the trade union, the youth union, and the heads of the sub-units; in large-scale units, the heads of sub-units may provide written comments.- The public employee presents the self-evaluation report at the meeting, and attendees provide feedback, which must be recorded in the minutes and agreed upon at the meeting.

- Collecting comments and evaluations from the party committee of the unit where the public employee works.

- Consideration and decision on the evaluation and rating of the public employee- The personnel advisory body of the evaluating authority consolidates feedback and recommendations for the evaluation and rating of the public employee.- The evaluating authority reviews and makes the final decision on the evaluation and rating of the public employee.

- The evaluating authority announces the results in writing to the public employee and publicly discloses the results within the unit where the public employee works; deciding on a public disclosure form, prioritizing electronic disclosure.

*** For public employee not holding managerial positions:

- Self-evaluation and rating by the public employee: The public employee prepares a self-evaluation report, proposing a rating based on the duties assigned, following Form 03 of the Appendix issued with this Decree.

- Evaluation and remarks on the public employee

- Organizing a meeting at the unit where the public employee works for evaluation and remarks.- The meeting's participants include all public employees of the unit or all public employees of the sub-unit where the public employee works in case of sub-units.- The public employee presents the self-evaluation report at the meeting, and attendees provide feedback, which must be recorded in the minutes and agreed upon at the meeting.

- Consideration and decision on the evaluation and rating of the public employee: The evaluating authority reviews the feedback provided during the evaluation meeting to make the final evaluation and rating decision.

- The evaluating authority announces the results in writing to the public employee and publicly discloses the results within the unit where the public employee works; deciding on a public disclosure form, prioritizing electronic disclosure.
