Guidance on Salary Classification for Communal Officials from December 25, 2019

Circular 13/2019/TT-BNV guiding several regulations on commune-level officials and part-time workers at the commune level, in villages, and neighborhood groups was issued on November 6, 2019.

The salary classification for commune-level officials is regulated as follows:

For commune-level officials who have graduated with a professional qualification from intermediate level or higher, their salary is determined based on the salary scale for administrative officials specified in salary table No. 2 (Professional salary table for officials in state agencies) issued alongside Decree 204/2004/ND-CP, specifically:

+ Commune-level officials who have graduated with a university or higher degree are classified under the specialist salary rank (applied to officials of type A1); those who have graduated with a college degree are classified under the assistant officer salary rank (applied to officials of type A0); those who have graduated with an intermediate level degree are classified under the staff salary rank (applied to officials of type B) according to Article 9a of Circular 11/2014/TT-BNV as amended and supplemented in Clause 6, Article 1 of Circular 05/2017/TT-BNV;

+ Graduation diplomas at intermediate level or higher must comply with the regulations of the Ministry of Education and Training and of authorized certifying agencies or organizations.

In the case that during the working period, a commune-level official undergoes a change in professional qualifications as stipulated in Clause 4, Article 5 of Decree 92/2009/ND-CP, as amended and supplemented in Clause 2, Article 2 of Decree 34/2019/ND-CP, if they have self-funded their studies (not sent to study by an authorized agency) and have not yet received the professional qualification diploma by June 25, 2019, they are classified under the new qualification salary rank from the date of receiving the diploma; in the case they have already received the professional qualification diploma, they are classified under the new qualification salary rank from June 25, 2019.

If, prior to recruitment as a commune-level official, a person employed in work relevant to the position of a commune-level official and has paid compulsory social insurance (if there is a period of work during which compulsory social insurance is paid non-continuously, not receiving lump-sum social insurance benefits, it can be accumulated), this period is used as a basis for appropriate salary classification for the recruited official position.

Based on the above regulations, the district-level People's Committee Chairman decides the salary classification for each case with changed professional qualifications; for cases with a period of work during which compulsory social insurance was paid when recruited into the commune-level official position, the principle and method of salary classification are regulated in Circular 79/2005/TT-BNV; Circular 02/2007/TT-BNV and other related documents.
