Guidance on Procedures for Evaluating Officials and Public Employees from August 20, 2020

From August 20, 2020, there will be many new regulations related to officials and public employees. Notably, the regulation on the assessment of officials and public employees. 1. Evaluation, Quality Classification of Officials

According to the regulations in Article 18 of Decree 90/2020/ND-CP on evaluation and quality classification of officials and public employees by the Government of Vietnam, there are 04 steps for evaluating and classifying the quality of officials. Specifically:

Step 1: Self-evaluation and quality classification by the official

The official makes a self-evaluation report on the performance results according to the assigned tasks using Form No. 02 in the Appendix issued together with Decree 90/2020/ND-CP.

Step 2: Feedback and evaluation of the official

At the agency, organization, or unit where the official works, a meeting will be held to give feedback and evaluate the official.

Participants of the meeting: All officials of the agency, organization, or unit or all officials of the constituent unit where the official works if the agency, organization, or unit has a constituent unit.

For officials who are the deputy heads of the agency, organization, or unit with a constituted unit, the participants include: the leadership collective of the agency, organization, or unit, representatives of the party committee, the trade union, the youth union of the same level, and the heads of the constituent units; for agencies, organizations, units of large scale, the heads of the constituent units can contribute opinions in writing.

At the meeting, the official presents a self-evaluation report on the performance results. The meeting participants give feedback, which must be recorded in the minutes and approved.

Step 3: Review, decide on the evaluation, quality classification of the official

The head of the agency, organization, or unit relies on the opinions at the feedback and evaluation meeting to decide on the evaluation content and quality classification level for the official.

For officials who are the deputy heads, feedback and evaluation from the party committee of the agency, organization, or unit where the official works must be obtained. The head of the agency, organization, or unit then relies on the feedback and related documents (if any) to decide on the evaluation content and quality classification level.

Step 4: Written notification

The competent authority shall notify the official in writing and publicly announce the evaluation results and quality classification in the agency, organization, or unit where the official works. The form of public announcement within the agency, organization, or unit is decided, with priority given to making it available in the electronic environment.

2. Evaluation, Quality Classification of Public Employees

According to the regulations in Article 19 of Decree 90/2020/ND-CP on evaluation and quality classification of officials and public employees by the Government of Vietnam, there are 05 steps for evaluating and classifying the quality of public employees. Specifically:

Step 1: Self-evaluation and quality classification by the public employee

The public employee makes a self-evaluation report on the performance results according to the assigned tasks using Form No. 03 in the Appendix issued together with Decree 90/2020/ND-CP.

Step 2: Feedback and evaluation of the public employee

At the unit where the public employee works, a meeting is held to give feedback and evaluate the public employee.

Participants of the meeting: All public employees of the unit or all public employees of the constituent unit where the public employee works if the unit has a constituent unit.

At the meeting, the public employee presents a self-evaluation report on the performance results. The meeting participants give feedback, which must be recorded in the minutes and approved.

Step 3: Review, decide on the evaluation, quality classification of the public employee

The competent authority for evaluation and classification relies on the feedback at the meeting to decide on the evaluation content and quality classification level for the public employee.

Step 4: Written notification

The competent authority for evaluation and classification shall notify the public employee in writing and publicly announce the evaluation results and quality classification in the agency, organization, or unit where the public employee works, with priority given to making it available in the electronic environment.

Note: The evaluation and classification of officials and public employees are carried out annually. The evaluation period for officials and public employees must be completed before December 15 each year, before the evaluation and classification of party members and the annual review of commendation and reward work in agencies, organizations, or units.

For public service providers in education, training, and other fields with work years ending before December each year, the head of the public service provider will decide the timing for the evaluation and classification of public employees.

Overall, the evaluation procedures for officials and public employees are relatively similar. Essentially, both officials and public employees must self-evaluate and classify their quality based on criteria such as ideology, ethics, lifestyle, demeanor, sense of organizational discipline, and performance of assigned duties. Based on the self-evaluation and feedback from their workplace, the competent authority will issue a written notification and publicly announce the evaluation results and quality classification at the workplace.
