The Ministry of Labor, Invalids and Social Affairs has recently issued Official Dispatch No. 4092/LDTBXH-ATLD seeking feedback on the Lunar New Year holiday schedule for 2018 for officials and public employees and employees of administrative agencies, public service institutions, political organizations, and socio-political organizations.
Article 115 of the Labor Code 2012 stipulates that the Lunar New Year holiday is 05 days. According to Article 8 of Decree 45/2013/ND-CP, the Lunar New Year holiday period can be chosen by the employer as either 01 day at the end of the year and 04 days at the beginning of the new year or 02 days at the end of the year and 03 days at the beginning of the new year. The Ministry of Labor, Invalids and Social Affairs (MOLISA) has recommended as follows:
Vietnamese official and public employees and workers of administrative agencies, public service units, political organizations, and socio-political organizations will be on Lunar New Year holiday from February 14, 2018, to the end of February 20, 2018 (i.e., from the 29th day of the 12th lunar month of the Year of the Rooster to the end of the 5th day of the first lunar month of the Year of the Dog.
In detail:
- From February 14, 2018, to the end of February 18, 2018 (i.e., from the 29th day of the 12th lunar month of the Year of the Rooster to the end of the 3rd day of the first lunar month of the Year of the Dog) are the holiday days;- The remaining days are regular weekly days off and compensation days for regular weekly days off.
According to the contents of the Proposal from the MOLISA, the 2018 holiday and Tet holiday periods are consecutive with regular weekly days off, without any situation of 01 or 02 working days interspersed among the holidays. Therefore, no swap of regular weekly holidays during the 2018 holidays and Tet holiday periods.
