Law amending and supplementing a number of articles of the Law on Officials and the Law on Public Employees was passed by the National Assembly at the 8th session of the XIVth National Assembly and will take effect from July 1, 2020.

This Law stipulates that an official is a Vietnamese citizen, recruited, and appointed into a corresponding rank, position, or title based on the job position in the agencies of the Communist Party of Vietnam, the State, and socio-political organizations at the central, provincial, and district levels; in the agencies and units of the People's Army that are not officers, professional soldiers, or defense workers; in the agencies and units of the People's Public Security that are not officers, non-commissioned officers serving under professional policies, or public security workers, on the payroll, and receive a salary from the state budget.
It can be seen, compared to current regulations in the Officials Law 2008, the revised Law has excluded those in the leadership and management apparatus of public service providers of the Communist Party of Vietnam, the State, and socio-political organizations from the definition of an official.
Thus, from July 01, 2020, the effective date of this Law, there will no longer be public service unit officials as there are currently.
In addition, the Law on Cadres, Officials, and Public Employees (Revised 2019) has also supplemented a method for promoting officials compared to current regulations. Specifically, the promotion of officials must be based on the job position, in line with the structure of official ranks of the agency, organization, or unit, and can be conducted through promotion exams or promotion consideration. (Currently, the Officials Law 2008 only stipulates that the promotion of officials is carried out through exams).
