The Ministry of Labor, Invalids and Social Affairs of Vietnam (MOLISA) has just issued the Draft Decision on Promulgating the Regulations on Recruitment, Acceptance, and Mobilization of Officials for Professional Work (not holding leadership or management positions) at State Management Units under MOLISA.
Draft Decision clearly states the recruitment methods and applicable subjects as regulated in Article 4 of Circular 13/2010/TT-BNV on guiding the recruitment and promotion of officials as follows:
Recruitment of officials into the State management units under the Ministry is conducted through two methods: competitive examination and acceptance without competitive examination for the following subjects:
- Officials of type D (clerks, subordinates or equivalent) are recruited through competitive examination;
- Officials of type C (specialists or equivalent) are recruited through competitive examination or acceptance without competitive examination;
- Officials of type B (principal specialists or equivalent) and officials of type A (senior specialists or equivalent) are recruited through the process of acceptance without competitive examination.
The Ministry of Labor, Invalids and Social Affairs has the authority to decide on the recruitment, acceptance, and transfer of officials to work at the Departments, Office of the Ministry, Inspectorate of the Ministry, General Department, divisions.
Conditions for registering for official recruitment in Vietnam
Officials registering for recruitment must meet the following conditions:
- Meet the conditions prescribed in Clause 1, Article 36 of the Law on Officials 2008.
- The official-using unit proposes conditions according to the requirements of the recruitment position based on the job description, linked with the specialized training, skills, and experience according to the professional standards of the recruitment position.
- Being reviewed, evaluated, and decided for recruitment by the Ministry of Labor, Invalids and Social Affairs.
Cases not eligible for official recruitment registration:
- Persons not residing in Vietnam;- Persons who have lost or have limited civil act capacity;
- Persons under criminal investigation, serving or having served a criminal sentence, decision of the court that have not yet had their convictions expunged; persons under administrative measures sent to a rehabilitation facility.
- During the official recruitment process, preferences in recruitment for specific subjects and priority points are as stipulated in Article 5 of Decree 24/2010/ND-CP.
Recruitment registration documents are regulated in Circular 13/2010/TT-BNV. Including:
- Official recruitment application form (Appendix 1 Circular 13);
- Resume with confirmation from competent authority within 30 days to the submission date of the application;
- Birth certificate copy;
- Copies of diplomas, certificates, and transcripts as required by the recruitment position;
- Health certificate issued by the competent medical authority within 30 days to the submission date of the application;
- Certificate of belonging to the priority group in official recruitment (if any) authenticated by the competent authority.
Regulations on subjects, content, and forms of examination; conditions for exam waivers; scoring methods; and determination of successful candidates are implemented according to Articles 8 to 11 Decree 24/2010/ND-CP.
Note that unsuccessful candidates will not have their results retained for subsequent examinations.
The annual recruitment plan must be submitted to the Ministry no later than March 30 each year, for the Ministry to review, approve, and organize implementation.
Notes on the form of official recruitment examination
- For written and multiple-choice tests: Each room accommodates a maximum of 50 candidates, each candidate sits at one desk or sits at least 1 meter apart.
- For oral examination: The exam room is arranged with desks for candidates to prepare answers after randomly drawing questions and desks for oral examination.
- For practical examination: The exam room is arranged according to the requirements of the practical content (equipment, laboratories, etc.)
Notification of exam results and recruitment
- Within 15 days from the date of the Minister's decision to approve the recruitment results, the Director of the Personnel Department shall send a notification recognizing the recruitment results to the candidates at the registered address.
- Within 30 days from the date of receiving the notification recognizing the recruitment results, the successful candidate must go to the Personnel Department to complete the recruitment dossier before receiving the recruitment decision
.- After the successful candidate completes the dossier, within 15 days, the Minister authorizes the Director of the Personnel Department to sign the recruitment decision for the successful candidate.
- Within 30 days from the date of the recruitment decision, the recruited official must report to the recruiting unit, except where the recruitment decision specifies another deadline.
- If the recruited official does not report to work within the specified time (without a legitimate reason or application for extension), the Director of the Personnel Department may sign a decision to cancel the recruitment decision and consider recruiting the next potential candidate.
Probation regime for recruited officials in Vietnam
The Draft Decision stipulates that recruited officials must implement the probationary policies as follows:
- 12 months for officials of type C;- 06 months for officials of type D;
The maternity leave under social insurance benefits, sick leave, temporary detention, temporary custody, temporary suspension from work are not counted towards the probation period.
Salary regime for probationary officials in Vietnam
- Probationary officials receive 85% of the level 1 salary of the recruitment grade;
- Probationary officials with a master's degree relevant to the recruitment requirements will receive 85% of the level 2 salary of the recruitment grade
