1. Who are cadres and civil servants?

In Clause 1, Article 4 of the Law on Cadres and Civil servants 2008, cadres and civil servants are defined as follows:

Cadres are Vietnamese citizens who are elected, approved and appointed to hold posts or titles for a given term of office in agencies of the Communist Party of Vietnam, the State, socio-political organizations at the central level, in provinces and centrally run cities (below collectively referred to as provincial level), in districts, towns and provincial cities (below collectively referred to as district level), included in the payrolls and salaried from the state budget.

2. Contents of cadre evaluation in Vietnam

In Article 28 of the Law on Cadres and Civil servants 2008, the contents of cadre evaluation are as follows:

- Cadres are evaluated based on the following:

= Observance of the line and policies of the Party and laws of the State;

= Political qualities, ethics, lifestyle and working manners and style;

= Capabilities of leading, administering and organizing task performance;

= Sense of responsibility in work;

= Results of performance of assigned tasks.

- Cadres shall be evaluated annually, before election, approval, appointment, planning, transfer, training and retraining and at the end of terms of office and rotation periods.

The competence, order and procedures for cadre evaluation comply with laws and regulations of competent agencies.

3. Competence to evaluate and classify cadre qualification in Vietnam

 

In Clause 1, Article 16 of the Decree 90/2020/ND-CP, the competence to assess and classify the qualification of cadres, civil servants and public employees is as follows:

The level competent to manage cadres shall evaluate and classify the qualification of cadres according to the cadre management decentralization.

4. Procedures for assessing and classifying cadre qualification in Vietnam

Pursuant to Article 17 of the Decree 90/2020/ND-CP,

 the order and procedures for assessing and classifying the cadre evaluation are carried out according to the following steps:

Step 1: Staff self-assess and grade qualification

Reporters will self-assess and receive the rating of work results according to their assigned responsibilities and tasks, using form No. 01 of the Appendix issued together with this Decree.

Step 2: Comment and evaluate staff

- Calling a meeting of the leaders of the agency or organization where the cadre works to discuss and evaluate the cadre. Officers present the report on their self-assessment of work results at the meeting, the members attending the meeting give comments; and the opinions must be recorded in the minutes and approved at the meeting.

- The level competent to manage cadres shall decide on the collection of comments and evaluations from agencies, organizations, and units under the leadership and direct management competence of the evaluated cadres.

Step 3: Collect comments and assessments from the party committee at the same level where the cadre works.

Step 4: Consider, decide to evaluate, and rank the qualification of cadres.

The staffing agency's staffing advisory body synthesizes comments and assessments according to the provisions of Clauses 2 and 3, Article 17 of the Law on Cadres and Civil servants 2008, and related documents (if any), and proposes evaluation content and qualification ratings for staff.

The level of competence required to manage cadres considers, decides to evaluate, and grades the qualification of the cadres.

Step 5: Announce the results of the evaluation and classification of staff qualification

The level competent to manage cadres shall notify in writing the staff and publicly announce the results of the assessment and qualification classification in the agency, organization, or unit where the cadre works;

Determine the type of publicity to be used in the agency, organization, or unit where the cadre works, and prioritize its use in the electronic environment.
