1. Grounds and principles for participating in the civil servant promotion exam in Vietnam 2023
In Clause 1, Clause 2, Clause 4, Article 30 of Decree 138/2020/ND-CP stipulates the grounds and principles for participating in the civil service promotion exam as follows:
- The promotion of the civil servant rank must be based on the job position and in accordance with the civil servant rank structure of the agency employing the civil servant, as approved by the competent authority.
- Based on the number of quota-raising targets of agencies or organizations using civil servants approved by competent authorities, the civil servant management agency is responsible for reviewing, determining, and making a list of civil servants who fully meet the criteria and conditions for taking the rank promotion exam.
The agency managing civil servants is responsible before law for the standards and conditions of civil servants appointed to participate in the rank promotion exam and for keeping and managing civil servants' registration dossiers for rank promotion exams in accordance with law.
2. Conditions for taking the civil servant rank promotion exam in Vietnam2023
Pursuant to Clause 3, Article 30 of Decree 138/2020/ND-CP, civil servants may register for the rank promotion exam when they fully meet the following criteria and conditions:
- Being graded at the level of completing tasks well or higher in the working year immediately preceding the year of competition for rank promotion;
Having good political and moral qualities; not within the time limit for disciplinary action; not during the implementation of regulations related to discipline specified in Article 82 of the Law on Cadres and Public Officials 2008, amended in 2019.
- Having the capacity, professional qualifications, and skills to take on a job position corresponding to the rank of civil servant higher than the rank of civil servant currently held in the same professional field;
- Satisfying the requirements for diplomas, certificates, and other requirements on professional and professional standards of the competition category;
In cases where civil servants have professional diplomas that have standardized output in foreign languages or informatics according to regulations that correspond to the requirements of the exam grade, they must satisfy the requirements on foreign language and informatics standards of the exam grade.
In cases where civil servants are exempt from taking foreign language or computer science exams as prescribed in Clauses 6 and 7, Article 37 of Decree 138/2020/ND-CP, they are required to meet the requirements of the foreign language and informatics standards of the exam category.
- Satisfy the requirements on the minimum working time for each civil servant rank specified in the professional and professional standards of the competition category;
In case a public servant who has worked for a period of time before being recruited or admitted has paid compulsory social insurance in accordance with the provisions of the Law on Social Insurance, working in a position that requires appropriate professional qualifications (if the working time is not continuous without receiving a lump-sum social insurance allowance, it will be accumulated), and that time is calculated by the competent authority as the basis for salary ranking in the current civil servant rank, it shall be counted as equivalent to the current civil servant rank.
In cases of equivalent duration, they must have at least 01 year (full 12 months) of holding the lower rank adjacent to the exam grade by the end of the time limit for submitting the application for registration for the rank promotion exam.
3. Regulations on consideration for rank promotion of civil servants in Vietnam 2023
Pursuant to Article 31 of Decree 138/2020/ND-CP, the consideration of raising the rank of civil servants is as follows:
A civil servant who fully meets the criteria and conditions specified at Points a, b and c, Clause 3, Article 30 of DDecree 138/2020/ND-CP shall be considered for promotion to the rank of civil servant in the following cases:
+ Having excellent achievements in public service activities during the time of holding the current civil servant rank, recognized by a competent authority;
+ Being appointed to hold leadership and management positions in association with the requirements of the working position.
- Requirements for outstanding achievements in public service activities specified at Point a, Clause 1, Article 30 of Decree 138/2020/ND-CP, including emulation titles, forms of commendation according to merits and achievements in the performance of tasks and official duties of civil servants as follows:
+ For raising the rank from employee rank or equivalent to officer rank or equivalent; from the rank of officer or equivalent to the rank of expert or equivalent: Received the Certificate of Merit from the Prime Minister and won the title of Grassroots Emulation Fighter twice;
+ For raising the rank from the rank of expert or equivalent to the rank of main expert or equivalent: Awarded the Third-Class Labor Medal and won the title of Emulation Soldier at the ministerial, departmental, provincial, and central mass organizations;
+ For raising the rank from the rank of main specialist or equivalent to the rank of senior specialist or equivalent: To be rewarded with the First-Class Labor Medal or to win the title of National Emulation Fighter.
- Based on the job position, in accordance with the civil servant rank structure of the agency employing civil servants approved by competent authorities, the agency employing public servants shall report to the civil servant management agency for consideration, deciding according to its competence, or submit it to a competent agency for consideration and a decision on the consideration of rank promotion for civil servants immediately after the civil servant meets the provisions of Clause 1, Article 30 of Decree 138/2020/ND-CP.
- Agencies managing civil servants are responsible before law for the standards and conditions of civil servants considered for rank promotion and keep and manage civil servants' registration dossiers for rank promotion consideration in accordance with law.
