Communal Police Officers Are Not Allowed to Receive Accusation Letters or Documents at Private Residences

Draft 2 of Circular Regulation on the implementation of democracy in investigation activities of the People's Public Security force, replacing the Regulation issued together with Decision 729/1998/QD-BCA (V19), is being put out for public consultation and is expected to come into effect in 2020.

This Draft stipulates that, when receiving crime reports and denunciations, officials and officers of the Commune, Ward, Commune-level Town, Police Station, and Police Post are not allowed to do the following:

- Actions prohibited by law for officials or armed force personnel;

- Receiving applications, letters, and addressing citizens' issues at their private residences or any place outside the police office, except in urgent cases where citizens report a crime; they must also immediately report to their direct leaders;

- Coercing, harassing, or seeking any form of benefit from individuals participating in legal proceedings, their relatives, and related agencies, organizations, or individuals;

- Advising the accused, their relatives, litigants, or other participants in the proceedings in a manner that causes the case or incident resolution to be non-conformable to the law;

- Unlawfully interfering in the resolution of cases or incidents or using their influence to affect those responsible for resolving the cases or incidents;

- Removing case files and documents from the office without assigned duties or without the consent of an authorized person.

According to this regulation, when receiving crime reports and denunciations, commune-level police officials and officers are strictly prohibited from receiving applications and addressing citizens' issues at their private residences or any place outside the police office. In urgent cases where citizens report a crime, they may receive the report at their private residence but must immediately report to their direct leaders.
