Civil Servants and Public Employees Only Eligible for Downsizing Policies Until the End of 2021

Currently, Decree 108/2014/ND-CP, which has been amended and supplemented by Decree 113/2018/ND-CP, stipulates the staff reduction policy applicable to the following subjects:

- Officials from the central level to the commune level;- Employees in public service providers;- Persons working under indefinite-term employment contracts as regulated in Decree 68/2000/ND-CP;- Chairman of the company, members of the Member Council, General Director, Deputy General Director, Director, Deputy Director, Chief Accountant, controllers in single-member limited liability companies owned by the State or by political organizations, social-political organizations (excluding General Directors, Deputy General Directors, Chief Accountants working under employment contract policies);- Persons who are officials authorized by competent agencies to represent the State's capital portion in enterprises having State capital;- Persons working within staffing quotas assigned by competent state agencies in associations.

The mentioned subjects will be subject to staff reduction if they fall into the cases regulated in Article 6 of Decree 113/2018/ND-CP, amending and supplementing Decree 108/2014/ND-CP. The staff reduction policy has been implemented since January 10, 2015 to present. However, according to Article 24 of this Decree, it is necessary to note:

Article 24. Effectiveness

1. This Decree takes effect from January 1, 2015. The policies stipulated in this Decree shall be applied until the end of December 31, 2021.

Therefore, Thu Ky Luat advises customers who are subjects to staff reduction to take note of the above regulations to ensure their rights.
