Changes to the salary increase regime for officials in the upcoming time in Vietnam

This is one of the notable contents in the Draft Circular amending and supplementing a number of articles of Circular 08/2013/TT-BNV on instructions for implementing the regime of regularly increasing salary levels and increasing salary levels ahead of time for civil servants and employees that are being issued by the Ministry of Home Affairs of Vietnam for comments.

Specifically, according to this Draft, in the near future, the regime of regular salary increases and advance salary increases for officials, civil servants, public employees, and employees will have some new points as follows:

*** Regarding the regular salary increase regime

First, the Draft amends the Standard for regular salary increases for civil servants (standard 1 point a Clause 2 Article 2) as follows: "Standard 1: Evaluated by competent authorities from the level of task completion upwards".

Currently, according to the provisions of Circular 08/2013/TT-BNV, this standard 1 is: "Evaluated by competent authorities from the level of task completion but with limited capacity upwards".

Thus, in the near future, if the Draft is approved, the standards for regular salary increases for civil servants will be higher than current regulations.

Second, the Draft adds additional cases that count in the time to consider regular salary increases compared to current regulations. Specifically, besides the 4 cases specified in Circular 08/2013/TT-BNV, the Draft proposes to add: "Duration of military service according to the Military Service Law" is also one of the cases that is counted in the time to consider regular salary increases for officials and civil servants.

Third, regarding the prolonged time for considering regular salary increases, the draft also amends and supplements regulations on extended time in cases where officials and civil servants both fail to complete their assigned tasks and are disciplined, specifically as follows:

- In case of not completing assigned tasks and being disciplined, the extended time for regular salary increases is the total of the extended times specified in Points a, b, and c of this Clause. In the event of being assessed for not completing tasks due to disciplinary action (same violation), the extended period of regular salary increase is only calculated according to one of the forms specified in Points a, b, and c of this Clause.

- In cases where officials, civil servants, public employees, and workers are receiving suspended imprisonment and disciplined by the law for the same violation, the period of regular salary increases is prolonged because the discipline coincides with the probationary period of the suspended sentence, and the time not counted for consideration of regular salary increases is the probationary period of the suspended sentence.

Currently, Circular 08 only stipulates: "In case of not completing assigned tasks and being disciplined, the extended time for regular salary increase is the total of the extended times specified in Points a, b, and c of this Clause."

*** Regarding the salary increase mechanism ahead of schedule

For the salary increase policy ahead of time due to excellent achievements in performing tasks, the draft amendments and supplements to the conditions and benefits prescribed previously at Point a of Clause 1 of Article 3 of Circular 08 are as follows:

For subjects specified in Clause 1, Article 1 of this Circular meet all 02 standards specified in Clause 2, Article 2 of this Circular who have made excellent achievements in performing tasks that have been recognized in writing by competent authorities, if the final salary level in the rank or position has not been ranked at the time of considering salary increases ahead of schedule due to outstanding achievements and lacks 12 months or less to receive a regular salary increase, they will be considered for a salary increase within a maximum of 12 months compared to the time specified in Point a, Clause 1, Article 2 of this Circular.

Currently, according to Circular 08: "by December 31 of the year of consideration for salary increase ahead of schedule, if there is 12 months or less left to receive a regular salary increase, they will be considered for a salary increase within a maximum of 12 months compared to the time specified in Point a, Clause 1, Article 2 of this Circular.

It can be seen that the Draft has changed the regulations on the timeline for calculating the number of missing months to consider raising the salary level ahead of schedule compared to the current one.
