Aside from recruiting officials through examination or selection, the head of a official management agency shall also decide to accept people who meet the criteria and conditions of the job position as an officials in the following cases:

Cases eligible of appointment as official without going through examination or selection in Vietnam (Illustration)
- Public employees working at public service units in Vietnam;
- Commune-level officials in Vietnam;
- People who receive salaries in Vietnamese People's Armed Forces, people who work in cipher organizations but are not officials;
- Accepting the appointment as officials holding leader and management positions for those who are currently the Chairman of the Members' Council, Chairman of the Board of Directors, President of the company, members of the Board of members, members of the Board of Directors Board of Directors, Controllers, General Director, Deputy General Director, Director, Deputy Director, Chief Accountant and persons holding other management positions and titles as prescribed by the Government in State – owned enterprise, enterprises in which more than 50% of charter capital is held by the State in Vietnam;
Recipients must be assigned to appointed position or equivalent positions;
- Persons who used to be officials and then transferred or rotated by competent authorities to hold working positions that are not official at other agencies and organizations.
The cases specified above will be considered for appointment as official if the following conditions are met:
- Must have full 05 years of work or more (excluding the probation period, if the working time is not continuous, it will be accumulated, including the working time, if any, in the previous job position that fall under the cases specified at Points a, b, c and d, Clause 1, Article 18 of Decree 138/2020/ND-CP)
- Perform jobs that require professional training in accordance with the job position to be recruited.
- Not within the time limit for disciplinary action, not during the implementation of regulations related to discipline.
