Application and procedures for increasing regularly salary of civil servants in Vietnam's Judiciary sector

When qualified, civil servants in the Judiciary sector will be considered for salary regular increases. Below is the application and procedures for increasing regularly salary of civil servants in Vietnam's Judiciary sector.

Application and procedures for increasing regularly salary of civil servants in Vietnam's Judiciary sector

1. Application for consideration of salary regular increase of judicial officers in Vietnam

- For the application file for the Head to consider raising the salary level

Application to request heads of units under the Ministry, heads of public service units under the Department, heads of public service units under the General Department of Civil Judgment Execution, and Directors of the Civil Judgment Enforcement Departments of provinces and central cities under the Central Government to consider and decide to raise the salary level regularly, including the following documents:

+ Report on reviewing and summarizing the regular salary increase of the personnel organization department or the officer in charge of the organization and personnel work of the unit;

+ Minutes of the meeting between the representative of the unit's leader and the representative of the unit's party committee and trade union;

+ A list of civil servants who are eligible, as well as the criteria for considering a regular salary increase for the unit.

- For application to request the Minister to consider raising the salary level

Application to request the Minister to consider and decide to raise the salary level regularly includes the following documents and documents:

+ A written request for consideration to raise the regular salary level of the unit;

+ Minutes of the meeting between the representative of the unit's leader and the representative of the Party committee and trade union of the unit under the Ministry (including the minutes of the meeting of the non-business units under the Department, the non-business units under the General Department of Civil Judgment Execution) if any), Civil Judgment Execution Departments of provinces and centrally run cities;

+ List of civil servants for whom the head of the unit has decided to raise their salary level on a regular basis in accordance with their decentralized management competence;

(made monthly or periodically by the unit; according to Form No. 01 attached to the Regulation).

+ List of civil servants who are proposed to raise their salary level regularly (according to Form No. 02 attached to the Regulation).

2. The procedures for increasing the regular salary levels of civil servants in Vietnam's judiciary sector.

Step 1: Create a list of civil servants who are eligible for salary increases.

The personnel organization department or the staff member in charge of the organization and personnel work of the units shall review and make a list of civil servants eligible for the period of holding rank in the civil servant rank;

Collect all relevant information, report to the Head of the Unit to organize the consideration of raising the regular salary level of the Unit.

Step 2: Approve the salary increase list

Heads of units under the Ministry, heads of non-business units under the Department, heads of non-business units under the General Department of Civil Judgment Execution, and Directors of Civil Judgment Enforcement Departments of provinces and centrally run cities (or representatives of the authorized unit leader) to meet with the Party committee and trade union representative of the unit to approve the list of civil servants eligible and standards for remuneration.

Step 3: Make a decision or propose a decision to raise the salary level.

Based on the results of the meeting, heads of units under the Ministry, heads of non-business units under the Department, heads of non-business units under the General Department of Civil Judgment Enforcement, Directors of Civil Judgment Enforcement Departments of provinces and cities directly under the Central Government consider and perform the following tasks:

- Sign the Decision to raise the regular salary level for qualified civil servants under their decision-making competence according to the civil servant management decentralization of the Ministry of Justice.

- Request the Minister to consider and decide to raise the regular salary level for qualified civil servants under the decision-making authority of the Minister according to the decentralization of civil servant management.

Applications shall be sent to the Department of Organization and Personnel (for units under the Ministry of Justice of Vietnam) and the General Department of Civil Judgment Execution of Vietnam (for Civil Judgment Execution Departments) before the 25th of every month.

Step 4: Summarize and submit the decision to propose a salary increase.

The Department of Organization and Personnel, General Department of Civil Judgment Execution, within the scope of its assigned responsibility, synthesizes proposals from the units, considers and decides or submits them to the Minister or Deputy Minister for consideration and decision according to their competence.
